The subject of the contract is the execution by the Contractor for the Employer (including design, delivery, assembly, commissioning, configuration and commissioning) of the investment entitled: "Installation of a new flue gas discharge installation from PTWM boilers No. 8 and 9 of the Siekierki CHP Plant in Warsaw".
1. The subject of the contract is the performance by the Contractor for the Contracting Authority (including design, delivery, assembly, commissioning, configuration and commissioning) of the investment entitled: "Construction of a new flue gas discharge system from PTWM boilers No. 8 and 9 of the Siekierki CHP Plant in Warsaw".
2. The scope of the contract includes, m.in design, delivery, assembly, commissioning, configuration and commissioning of a new flue gas outlet, which includes, among others:
- a new chimney with the necessary installations,
- new flue gas ducts with the necessary cut-offs,
- two new exhaust fans,
- new and modernized power supply and control installations for the new flue gas discharge system,
- new and upgraded emission monitoring installations (CEMS),
- buildings, installations and existing infrastructure necessary for the development of the Installation,
- all devices, installations and other elements necessary for the proper functioning and safe operation of the Installation.
3. The subject of the contract will be executed by the Contractor according to the "turnkey" formula in accordance with:
- Draft provisions of the agreement 23DOZZ119 and attachments (in particular with the technical concept developed by PROEN GLIWICE sp. z o.o. with its registered office in Gliwice, i.e. Technical Concept No. 04/ECS/2021 for the construction of a new steel chimney for PTWM-100 boilers No. 8 and 9, excluding the demolition of the existing chimney and flue constituting Appendix No. 1 to the Draft provisions of the agreement 23DOZZ119, as well as industry appendices describing the boundaries and requirements, which are also appendices to this Draft Provisions of Agreement 23DOZZ119,
- documentation prepared by the Contractor and agreed with the Contracting Authority.
4. The "turnkey" formula means comprehensive performance by the Contractor of all works in all industries in order to implement the subject matter of the Contract and ensure its functioning in accordance with the terms and conditions of the Agreement, including, m.in. performance of such works as: development of complete technical documentation (including, m.in, inventory, measurements and tests, construction design, detailed and as-built designs and other documentation in all trades), carrying out appropriate arrangements, official proceedings and performing all activities for the purpose of obtaining appropriate opinions, decisions, official and formal permits (with the exception of amending or obtaining a new decision on environmental conditions, which is within the scope of the Contracting Authority's obligations, ), preparation of the site and construction facilities, fencing of the workplace, complete disassembly and assembly as well as execution of temporary and other installations, delivery of all materials, apparatus, fittings and equipment necessary to perform the works, execution of the necessary spacers and demolition, execution of all transport works, implementation of complete construction, assembly, installation, facility and programming works (including on the side of the digital system), utilization of waste generated as a result of carrying out works, regulation and
commissioning of the facilities included in the Installation, organization and participation of m.in. in the test run of the Installation and its commissioning, performance of all necessary accompanying and finishing works, both those included and not included in the tender materials and the submitted offer, provision of services resulting from warranty obligations and performance of all other necessary works to ensure the completeness of the performance of the subject matter of the Agreement, in accordance with its formula "under the key".
