The subject of the contract are catering services provided for soldiers performing round-the-clock duty services and other persons authorized to feed in the complexes being on supply of the 31st Tactical Air Base. The services will be provided in a continuous system 7 days a week, in accordance with the description of the subject of the contract contained in Annex 6 to the SWZ. A detailed description of the subject of the order and recommended sizes of food and beverages, a list of receivables dimensions, quality requirements for the subject of the order, are specified in the descriptions of the subject of the contract - Appendix No. 6 to SWZ. The Ordering Party stipulates that the distance between the place of preparation of meals and the place of their consumption may not be greater than 15 kilometers. This is related to the specificity of compliance with the order of the day specified in Military Units, which is subject to strictly defined regimes, including the issuance of meals on time. The Contractor is obliged to indicate the place of preparation of meals in the Offer Form.

A detailed description of the subject of the order and recommended sizes of food and beverages, a list of receivables dimensions, quality requirements for the subject of the order, are specified in the descriptions of the subject of the contract - Appendix No. 6 to SWZ. Pursuant to Article 95 of the PPL, the Contracting Authority requires the Contractor or Subcontractor to employ persons preparing meals on the basis of an employment relationship, if the performance of these activities consists in performing work in the manner specified in Article 22 §1 of the Act of 26 June 1974 - Labour Code.

The method of verifying the employment of these persons, the rights of the contracting authority in the scope of control of compliance by the contractor with the requirements related to the employment of persons and sanctions for failure to meet the requirements related to the employment of persons are included in the draft contract – Appendix No. 7 to the SWZ.

1. In order to confirm that the offered supplies meet the requirements and characteristics specified by the Ordering Party, the Ordering Party requires the submission of the following means of proof:

Current document confirming the use of the implemented HACCP system:

a) certificate of the HACCP system implemented by companies accredited and authorized by the Polish Centre for Accreditation based in Warsaw,

or

b) Certificate of the competent authority of the State Sanitary Inspection or the competent authority of the Veterinary Inspection on supervising the application of the principles of the implemented HACCP system.

The submitted certificate should confirm that the Contractor has implemented and applies the principles of the HACCP system – Legal basis: Articles 59 and 73 of the Act of 25 August 2006 on food and nutrition safety.

In the case of Contractors jointly applying for the award of the contract, the implemented safety system – HACCP must have each of the Contractors.

2. The Contractor shall be obliged to submit the said means of proof together with the tender.

3. The contracting authority does not provide for supplementing the means of proof in question.

A detailed description of the subject of the order and recommended sizes of food and beverages, a list of receivables dimensions, quality requirements for the subject of the order, are specified in the descriptions of the subject of the contract - Appendix No. 6 to SWZ. Pursuant to Article 95 of the PPL, the Contracting Authority requires the Contractor or Subcontractor to employ persons preparing meals on the basis of an employment relationship, if the performance of these activities consists in performing work in the manner specified in Article 22 §1 of the Act of 26 June 1974 - Labour Code.
