1. The subject of the contract is defined by: Draft Provisions of the Agreement (PPU) – Annex 6 to the SWZ, Description of the subject of the contract, technical documentation indicated in § 1 section 1 points 1)-3) PPU, Functional and Utility Program (PFU) – attachments2. The Contractor should carry out the investment task in accordance with the requirements specified by the Contracting Authority and the principles of technical knowledge and from the point of view of the purpose served by the subject of the contract, under the conditions set out in:1) Technical documentation indicated in §1 section 1 points 1)-3),2) Functional and Utility Program, hereinafter referred to as PFU,3) Specification of the terms of the contract, hereinafter referred to as "SWZ"4)provisions of this contract5) the Contractor's offer 6) legal provisions, in particular in applicable standards, in the Act of 7 July 1994. Construction Law (Journal of Laws of 2023, item 682) and in the Act of 10 April 2003 on specific rules for the preparation and implementation of investments in the field of public roads (Journal of Laws of 2022, item 176).

The material scope includes:1) Reconstruction of the provincial road No. 812 – Zawadówka Street in Chełm, in the scope of construction of a bicycle path on the basis of the design documentation provided by the Contracting Authority and a current certificate of non-objection to the notification of construction works, sign IF-I.7843.3.41.2022.AM of 29 July 2022; 2) Reconstruction of the voivodship road No. 812 – Włodawska Street in Chełm, in the scope of construction of a bicycle path on the basis of the design documentation provided by the Contracting Authority and a current certificate of non-objection to the notification of construction works, sign IF-I.7843.3.29.2023.AM of June 13, 2023; 3) Renovation of the voivodeship road No. 812 – Włodawska Street and Zawadówka Street in Chełm on the basis of the design documentation provided by the Contracting Authority and a current certificate of non-objection to the notification of construction works, mark IF-I.7843.3.2.2022.AM.PP of 24 February 2022; 4) improving the technical parameters of the voivodeship road No. 844 located on the communication route connecting the intermodal terminal at Wschodnia Street with border crossings in Dorohusk, Zosin, Hrebenne, Sławatycze (DW 844 – Hrubieszowska Street, Al. Żołnierzy I AWP, Al. Armii Krajowej together with the construction of a viaduct – in the "design and build" formula.5)Reconstruction of district roads (No. 1880L, 1920L, 1893L, as necessary investments connecting the investment areas of the City with the terminal and creating alternative access from the Chełm Centre of Economic Activity to the terminal (1880L – Ceramiczna Street, 1920L – Szpitalna Street, 1893L – Lubelska Street together with the bridge over Uherce, from Szpitalna Street to the John Paul II roundabout) – in the "design and build" formula. The Contractor is obliged to pay a bid bond on the terms set out in the SWZ in the amount of: PLN 2085144.00The contractor whose offer is considered the most advantageous will be obliged to lodge a performance bond in the amount of 5%. The Contractor may entrust the performance of part of the contract to Subcontractors.Contractors may jointly apply for the award of the contract. In such a case, the Contractors shall appoint a representative to represent them in the procurement procedure or to represent them in the procedure and conclude a public procurement contract. The power of attorney should be attached to the offer in electronic form. In the proceedings in question, communication between the Contracting Authority and the Contractor, including the submission of tenders, exchange of information and the transfer of documents or statements, taking into account the exceptions provided for in the Act, takes place using electronic means of communication, via the Platform located at: https://umchelm.ezamawiajacy.pl in the "Correspondence" tab. General rules for using the Platform:1) notification to the proceedings requires the Contractor to log in to the System on the subdomain Name of the Unit; https://umchelm.ezamawiajacy.pl or https://oneplace.marketplanet.pl.2) After selecting the "Join the proceedings" option, the Contractor will be redirected to the https://oneplace.marketplanet.pl website, where he will be notified about the possibility of logging in or creating a free account. The Contractor creates an account by following the steps of the registration process; provides an e-mail address, sets a password, then repeats the password, enters the code from the picture, accepts the regulations, clicks the "register" command.3) Registration of the Contractor: Account registration takes place automatically by: - signing the application with an electronic signature (qualified, personal or trusted profile) or contacting the phone number provided in the confirmation, or - if the user does not sign the application or contact by phone - the account will be activated in within a maximum of 6 working hours. Details are included in the procurement documents. The offer should be made in Polish and submitted under pain of nullity in electronic form with a qualified electronic signature, via the Platform.
