The tendered contract covers design, development and delivery of a complete solution for storing, handling and integrating data. The solution is divided into three sub-deliveries: a data platform, integration platform and integration interfaces to the Ordering Entity's existing analysis platform. In addition, the contract includes the possibility of subsequent purchase of maintenance, development and training.
The contract includes the delivery of a total solution for storage, handling and integration of heat meter data (the Solution), divided into three sub-deliveries; a data platform, an integration platform, as well as integration interfaces to the Ordering Entity's existing analysis platform.
As the Contracting Entity has not decided on a specific architecture or technology for the Solution, the aim of the tender is to select a supplier who, in cooperation with the Client, can plan, design and set up the Solution in an agile project. Therefore, the solution and the tenderer's services do not determine why the Contracting Entity has considered it most appropriate that the winning bidder is settled according to time spent. For the same reason, the requirement specification in Appendix 2 expresses the Client's wishes and needs for the Solution and does not contain mandatory requirements or minimum requirements. The tenderer is therefore free to propose a solution architecture and technology that best meets the Contracting Entity's wishes (Appendix 2).
In parallel with this tender, the Contracting Entity tenders a contract for the supply of a metering and take-home infrastructure for the collection of heat data. It is this data that the Solution under this tender must be able to handle. Therefore, it is important for the Ordering Entity that the data platform (which is Subcontract 1) is delivered and commissioned at the time when the first new meters from the meter tender are installed. The contracting entity expects this to be 1 November 2023, so the tenderer is asked to provide a timetable for the Acquisition of the data platform (Sub-delivery 1) from this date (Appendix 1).
It is a particularly important wish for the Ordering Entity that the Ordering Entity obtains full ownership of the Solution, just as the Ordering Entity also wishes to operate the Solution itself via its regular operating supplier. The contract therefore does not cover the operation of the Solution.
After delivery and acceptance of all three sub-deliveries, the Ordering Entity wishes to purchase assistance for e.g. maintenance, further development or further training of the Client's staff.
The contracting entity has considered the possibility of splitting the tendered contract, but has opted out of this, as a division is expected to result in a number of inappropriate technical and legal interfaces, resulting in financial risks and transaction costs.
The contracting entity may choose to award the contract on the basis of the initial tender. If the contracting entity chooses to enter into negotiations, the contracting entity is prepared to negotiate all parts of the tender documents, provided that such negotiations cannot lead to the modification(s) of terms which, in the circumstances, must be considered fundamental. The contracting entity reserves the right to conduct several rounds of negotiations. Furthermore, the Contracting Entity reserves the right to negotiate in writing with the tenderers, i.e. without holding negotiation meetings.
