Description:
Framework agreement to replace safety barriers on alternate sections of lot B - A12 from Brugnato to Sestri Levante - CIG: 797938901D - CUP: I37H18001100005.

The works consist of replacing the existing barriers with new-generation class H4 safety barriers on viaducts, on the approach walls in general, and on embankments. All the by-passes that will be replaced will instead be class H3. Inside the intervention there are 15 main works of art (viaducts).

The description of the interventions is contained in the tender documents.

The intervention project was validated on 10.7.2019.

The framework agreement has a duration - understood as the period within which the customer can entrust the interventions included in the project based on the tender - of 4 years starting from the relative stipulation, except for early termination in the cases provided for by point VI.3 ), letter S.

The total amount of the framework agreement, including security charges, is EUR 15 387 964.26, excluding VAT.

The starting price of the auction, net of security charges, is EUR 15 253 342.02 to be compensated.

The security charges, not subject to auction discount, are equal to EUR 134 622.24 to be compensated in body.

The overall amount of the framework agreement represents the summation of the individual application contracts that may be stipulated under the framework agreement.

The contract will be compensated in full.

Pursuant to art. 23, paragraph 16 of Legislative Decree no. 50/2016 and subsequent amendments (hereinafter also the code) the amount based on the tender includes the labor costs that the contracting station has estimated to be equal to 27.860% of the works, VAT and security charges excluded.

The most economically advantageous offer, pursuant to art. 95, paragraph 2 of the code, according to the criteria and parameters indicated in detail in the document «Evaluation criteria» forming part of the tender documents.

The competitors can benefit from the increase of the classification within the limits and under the conditions indicated in the art. 61, paragraph 2 of Presidential Decree no. 207/2010 as in force.

Any subcontracts will be regulated pursuant to art. 105 of the code and other applicable regulations in force. For details see the Tender Regulations.

Payments relating to the work performed by the subcontractor or job manager will be made (except as provided for by Article 105, paragraph 13 of the code, with the lawful verification of invoices by the contractor) by the contractor who is obliged to transmit to the client, within twenty days of the date of each payment made, a copy of the receipted invoices indicating the guarantee withholdings made.

In case of availment, the competing economic operator will have to attach what is required by article 89 of the code. The auxiliary subject must make the declarations referred to in point III.1) in the same manner prescribed for the competitor and specified in the Tender Regulations.

The contract cannot be subdivided into lots as these are interventions that for safety reasons must take place in strictly coordinated phases.

It should be noted that the award will be made by resolution of the competent bodies of the contracting station.

Works carried out in self-financing.

The successful bidder will be paid, under the conditions and in the manner indicated in the art. 35, paragraph 18 of the code, an advance equal to 20% of the amount of each individual application contract activated in the framework agreement.

Payments will be made on account, based on the progress of bimonthly work and final balance.

The accounting of the works will be carried out in accordance with the regulations governing public works.
