1. The subject of this contract is: 1.1. supply of electricity to facilities listed in Annex 1 to the SWZ – description of the subject of the contract. The demand for electricity in the period from 01.06.2023 to 31.12.2024 is: 4 318 466 kWh (planned order). 1.2. commercial balancing service (hereinafter also referred to as the POB service) for energy consumption points with installed RES Installation (micro-installations and small installation) in the period from 01.06.2023 to 31.12.2024 Information on RES installations is included in Annex 1 to the SWZ description of the subject of the contract. Energy production takes place all year round, 24 hours a day (except for maintenance breaks and breakdowns). The amount of energy produced by the installations and put into the grid during the term of the contract is: 30 145 kWh (planned amount). Information on the amount of energy generated and returned to the grid is included in Annex 1 to the SWZ. The energy will be used for the customer's own needs.

Other information on RES installations: a) the contracting authority is an entity – a producer of energy in a small installation – entered in the MIOZE register (entry number MIOZE/URE00504/2018 of 01.03.2018), b) the contracting authority has concluded electricity purchase agreements with Enea SA. for a definite period until 31.12.2024, c) a contract will be concluded with the contractor selected in these proceedings for the sale of electricity and for the POB service of energy generated by the contracting authority's RES installations and put into the network – according to the template constituting Annex 2 to the SWZ. The agreement for the sale of electricity together with the POB service of energy generated by the RES installation and put into the grid will be concluded for a definite period from 01.06.2023 to 31.12.2024. d) the agreement for the repurchase of electricity from the installation (hereinafter also referred to as the Power Purchase Agreement) will be concluded for a definite period from 01.06.2023 to 31.12.2024 or for an indefinite period. The decision on the term of the contract will be made by the parties to the proceedings before the conclusion of the electricity sale agreement. The contract is not subject to PPL regulations. The contract will be concluded in accordance with the applicable provisions of the Civil Code. (e) the amount of electricity for which the POB service will be provided shall be the actual amount of energy that will be returned to the distribution network. The settlement of the quantity of electricity purchased by the contractor will take place on the basis of electricity actually delivered to the distribution network in settlement periods of 1 quarter, determined by the DSO on the basis of indications of metering and settlement systems and provisions of distribution service agreements. 2. The contractor selected in these proceedings undertakes to purchase electricity generated in the contracting authority's installations. The contractor selected in these proceedings undertakes to conclude with the contracting authority a contract for the sale by the contracting authority to the contractor of electricity generated in the contracting authority's installation - the Energy Purchase Agreement. The conclusion of the Power Purchase Agreement must take place before the conclusion of the electricity sale agreement on the template proposed by the contractor, taking into account the provisions of the agreement for the Energy Purchase Agreement constituting Appendix No. 3 to the Draft provisions of the agreement - Appendix No. 2 to the SWZ. 3. The detailed scope of the contract is specified in Annex 1 to the SWZ, in accordance with the provisions of the Energy Law Act of 10 April 1997. Other conditions regarding the performance of the contract are specified in the draft provisions of the electricity sales agreement – Annex No. 2 to the SWZ and in the SWZ in Section 4.
