1. The subject of the contract is the provision of mobile telephony services along with the supply of mobile phones, modems and SIM cards for State Administration Units indicated in Annex 1 to the SWZ.
2. The service will be provided through the use of inactive SIM cards provided by the Contractor, and brand new devices free from physical and legal defects, i.e. mobile phones and modems for data transmission with the possibility of Internet access in GSM, UMTS and LTE technology with two-way data transmission.
3. The detailed manner of implementation of the subject of the contract is specified in Annex 2 to the SWZ – Draft provisions of the contract.

2. The service will be provided through the use of inactive SIM cards provided by the Contractor, and brand new devices free from physical and legal defects, i.e. mobile phones and modems for data transmission with the possibility of Internet access in GSM, UMTS and LTE technology with two-way data transmission.
3. The detailed manner of implementation of the subject of the contract is specified in Annex 2 to the SWZ – Draft provisions of the contract.
4. The detailed scope of the contract is set out in Annex 1 to the SWZ.
5. In order to confirm that the offered devices (mobile phones and modems) meet the requirements or features specified by the Contracting Entity, the Contracting entity shall submit together with the offer a document (device data sheet or device specification or manufacturer's statement or statement of the manufacturer's authorized representative), confirming that each offered device meets all the parameters specified in the Technical Specification of the devices attached to it No. 3 to SWZ.
6.The Contracting Authority requires the Contractor to provide the Entities covered by the contract with access to an electronic system enabling secure and independent handling of the account configuration of each Unit, called the Service Portal.
7. The Contracting Authority requires that to confirm that the offered Service Portal meets the requirements set out in Chapter VI, subsection I, point 21 points 2 - 7 SWZ, the Contractor shall submit together with the offer the means of proof in question, i.e.: Description of the Service Portal containing information on the compliance of the offered Service Portal with the requirements contained in the SWZ, indicating the website address at which the Service Portal offered by the Contractor is available.
8. If the Contractor fails to submit the evidence referred to in points 5 and 7 together with the bid or the evidence submitted is incomplete, the Contracting Authority shall call for their submission or supplementation within the prescribed period, unless despite the submission of the said evidence, the offer is subject to rejection or there are grounds for invalidating the proceedings. The contracting authority may request explanations regarding the content of the evidence in question.
9. The Contracting Authority requires that, as part of the remuneration indicated in the offer, the Contractor prepares training in the operation of the Service Portal, in accordance with the description indicated in Chapter VI, Subchapter I, point 25 of the SWZ.
10. The Contracting Authority requires the Contractor to provide a dedicated hotline, operated by a team dedicated to servicing the Units covered by this contract, in accordance with the description indicated in Chapter VI, Subsection I, point 26 of the SWZ.
11. Acting pursuant to Article 95(1) of the PPL, the Contracting Authority requires that throughout the term of the Main Agreement, persons (consultants) dedicated to operating the hotline to the extent consistent with the description indicated in Chapter VI, subsection I, point 26 of the SWZ, be employed by the Contractor and/or its Subcontractor on the basis of an employment relationship, in accordance with Article 22 § 1 of the Act of 26.06.1974 - Labour Code. Detailed requirements in this respect are described in the Draft provisions of the agreement constituting Annex 2 to the SWZ.
12. The contracting authority may annul the contract award procedure if the funds which the contracting authority intended to spend to finance all or part of the contract were not awarded to it.
