The subject of the contract is the service of maintaining the IT system of the National Access Point for information on traffic conditions. As part of the order, modifications will be introduced allowing access to a wider group of users to KPD data, and it will also be possible to develop the system in relation to the needs identified in the course of the contract.

Due to the limited number of characters in the announcement, detailed information on the procedure is contained in the ToR and annexes made available by the Employer.

Communication between the contracting authority and contractors in these proceedings takes place using the purchasing platform https://gddkia.eb2b.com.pl.

The contractor is obliged, among others down:

1. Conducting works related to the performance of the contract in accordance with the contract,

2. Ensure that the software operates in accordance with the functional and non-functional requirements described in Annexes 1 - "Functional requirements" and No. 2 "Non-functional requirements",

3. Takeover and launch of the KPD service in the service model based on an external environment that meets the requirements set out in Annexes 1 - "Functional requirements" and No. 2 "Non-functional requirements"

4. Updating KPD documentation (including description of all KPD components, software, processes, description of the Communication Interface, interface for the Employer and software interfaces) in the scope of introduced changes during the period of taking over and starting the service and later in connection with the modification of KPD, at the level of detail, which will allow the Employer and the next KPD Contractor to provide the KPD service itself, as well as to configure, integrate and extend the functionality of KPD based on a different external environment.

5. Development and implementation of the plan and test scenarios for testing new functionalities and modifications of the KPD, and then, on their basis, testing the correctness of KPD's operation with the participation of the Employer

6. Provision of the KPD service in accordance with the conditions described in Annex 3 'Requirements for SLA parameters',

7. Registration of users reporting interest in using the KPD and ensuring that they use the data collected by the KPD in a secure and convenient manner after prior verification and approval by the Employer,

8. Provide comprehensive user support, also in the field of launching services by data providers or data recipients,

9. Provide the Employer with monitoring of all activities carried out as part of the provision of the KPD service, including the activity of all users in a continuous, effective and reliable manner,

10. Conducting training and job instructions, including for the Employer and data providers and Data recipients in accordance with the requirements contained in Annex 2 - "Non-functional requirements",

11. Ensuring the possibility of transferring, launching and developing the Dedicated Software and using data in other external environments after the termination of the Agreement.

12. Ensuring compliance with art. 25 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27.4.2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46 / EC.

2. The contracting authority provides for the possibility of annulment of the contract award procedure pursuant to art. 93 item 1a of the Public Procurement Law, if the funds which the Employer intended to allocate for financing all or part of the contract will not be awarded to him.

3. Note to section II.2.7) of the announcement: The contracting authority requires performance of the contract within 24 months of commencing the provision of the maintenance service. The scope of the subject of the contract will be completed in the following periods:

a. Maintenance service - the KPD maintenance service is provided over a 24-month period. The provision of the maintenance service should start on 6.12.2019 with the following caveat: if the contract is concluded later than 14 days before 6 December this year. The contractor will start providing maintenance services no later than 14 days from the date of the contract.

b. Modification - works on the KPD modification will be carried out within 3 to 7 months (depending on the declaration made in the offer regarding the modification deadline criterion) months from the commencement of the maintenance service.

c. Development works - works on changes and development of the KPD carried out during the term of the contract on the basis of orders issued on the terms set out in §6 IPU "Development works".
