4.1. The subject of the contract is the collection and management of municipal waste from the area of the Nowosolna Commune from the owners of real estate on which residents live, from the owners of real estate on which residents do not live and municipal waste is generated and from the owners of real estate on which there are summer houses or other properties used for recreational and leisure purposes used only for part of the year, in the period from 01.01.2023 to 31.12.2023.
4.2. A detailed description of the item of the order is set out in the Description of the item of the order, as set out in Annex 1 to SWZ.
4.1. The subject of the contract is the collection and management of municipal waste from the area of the Nowosolna Commune from the owners of real estate on which residents live, from the owners of real estate on which residents do not live and municipal waste is generated and from the owners of real estate on which there are summer houses or other properties used for recreational and leisure purposes used only for part of the year, in the period from 01.01.2023 to 31.12.2023.
4.2. A detailed description of the item of the order is set out in the Description of the item of the order, as set out in Annex 1 to SWZ.
4.3. The Contracting Authority shall not permit the possibility of submission of partial tenders. The organisational structure of the Contracting Authority does not allow coordination and control of the subject matter of the contract in the event of the subdivision of the contract into parts and the possibility of submitting partial tenders.
4.4. The Ordering Party does not allow the possibility of submitting partial and variant offers.
4.5. The Ordering Party does not intend to conclude a framework agreement.
4.6. The Ordering Party does not intend to establish a dynamic purchasing system.
4.7. The Ordering Party does not intend to select the most advantageous offer using an electronic auction.
4.8. The Contracting Authority, in accordance with Article 139(1) of the Act, provides for the possibility of first evaluating the tenders, and then examining whether the Contractor whose offer has been assessed as the most advantageous is not subject to exclusion and meets the conditions for participation in the procedure.
4.9. Pursuant to Article 95(1) of the Act, the Contracting Authority requires the contractor to employ persons performing activities in the scope of contract performance within the meaning of the provisions of the Act of 26 June 1974 – Labour Code (i.e. Journal of Laws of 2022, item 1510, as amended), i.e.:
(a) drivers of motor vehicles – garbage trucks;
b) manual workers in the scope of: transport of waste from the property to the waste collection point or waste transhipment point, verification of the condition of containers, exchange of containers, work on sorting, waste handling and their selection;
(c) workers carrying out ongoing repairs of waste reception vehicles;
4.10. Requirements specifying, in particular, the manner of documenting the employment of persons referred to in Article 95(1) of the Act, the Contracting Authority's rights to control the Contractor's compliance with the requirements referred to in Article 95(1) of the Act, and sanctions for non-compliance with these requirements are specified in the model contract constituting Annex 7 to the SWZ.
