The aim of the present procurement project is the award of a framework agreement on the provision of bicycles by way of leasing by deferred compensation for the employees of ekom21 – KGRZ Hessen, ekom21 GmbH and KIV Thüringen GmbH between the clients as lessees on the one hand and a competent and efficient service provider together with a lessor as financing partner on the other. Both the service provider and the lessor jointly become contractors of the framework agreement. The framework agreement regulates the basic service relationships between the client and the contractor and also contains the essential requirements for the respective individual leasing contracts on the one hand and for the transfer and deferred compensation agreement for use by the employees on the other. The individual leasing contracts as well as the transfer and deferred compensation agreements are concluded separately.
ekom21 – KGRZ Hessen and its subsidiary are the largest municipal IT service providers in Hesse and are among the three largest BSI-certified municipal IT service providers in Germany. The task and business area of ekom21 – KGRZ Hessen and KIV Thüringen GmbH is to provide IT services, such as the (decentralized) provision of software, delivery of hardware or service and maintenance services, for municipalities, public institutions, hospitals, homes, regional councils, ministries and state associations. At the locations in Kassel, Giessen, Darmstadt and Gotha, more than 770 employees perform these tasks and provide IT services for the public sector, especially in Hesse and Thuringia, in over 50 specialist procedures. As a corporation under public law, the majority of which is supported by municipalities, ekom21 – KGRZ Hessen and its subsidiary are municipal employers. They belong to the Kommunale Arbeitgeberverband Hessen e.V., so that the approximately 720 employees are subject to the collective agreement for the public service ("TVöD"). With effect from 1 March 2021, this was supplemented for all employees of municipal employers – with the exception of trainees, pupils, dual students, interns, marginally employed persons and employees in the release phase – by the collective agreement on deferred compensation for the purpose of leasing bicycles in the municipal public sector of 25 October 2020 ("TV bicycle leasing"). KIV Thüringen GmbH, on the other hand, is not bound by collective agreements.
Against this background, the clients intend to introduce a bicycle leasing offer that enables them to lease bicycles, e-bikes and cargo bikes within the meaning of § 63a StVZO ("bicycles") as well as leasing accessories from a company after TV bicycle leasing and to make them available to employees for use using collective agreement and tax relief. The object of the procurement project is the award of a framework agreement between the contracting authorities as lessees on the one hand and a competent and efficient service provider together with a lessor as financing partner on the other, on the basis of which individual leasing contracts for the provision of bicycles and accessories for the employees of the contracting authorities can be concluded.
The main items of performance include:
(1) introduction of the framework agreement into the administrative structures of the contracting entities, in particular through the availability of a (deputy) project manager and training of the personnel managers of the contracting entities;
(2) Implementation of the framework agreement and handling of the procedure for the provision of the bicycle through the operation of an online platform and the availability of contact persons for the persons responsible to the clients, for example in the case of questions regarding individual leasing contracts;
(3) Provision of bicycles and leased accessories (e.g. bicycle lock, lights, pedals, etc.) at the employee's choice on the basis of an individual leasing contract between a client as lessee and the contractor as lessor;
(4) marketing of bicycle leasing to employees;
(5) Provision of insurance benefits for defined insured events and handling of incident management
(6) Services for the employees, such as annual maintenance and inspection services on the bicycles.
The contracting entities intend to conclude the framework agreement as a basis for the provision of services for a period of six years. The clients reserve the right to call off at least 50 to a maximum of 1,600 individual leasing contracts during the entire term of the framework agreement.
