The subject of the contract is the development, delivery and implementation of the Library System at the Ordering Party in order to facilitate access for students with disabilities to the resources of the Library of the Ignatianum Academy in Krakow in the form of a Digital Library with a Lending Library, integrated with the Koha System.

The subject of the contract is the development, delivery and implementation of the Library System at the Ordering Party in order to facilitate access for students with disabilities to the resources of the Library of the Ignatianum Academy in Krakow in the form of a Digital Library with a Lending Library, integrated with the Koha System, hereinafter also referred to as the "System" or abbreviated as "SB" or "Subject of the Contract".

The subject of the contract includes in particular:

1) performing the Pre-implementation Analysis and delivering a pilot version of the System;

2) development, delivery and implementation of the System at the Ordering Party, which will meet all the requirements described in the SWZ (in particular in the Detailed Description of the Subject of the Order – Annex No. 1A and 1B to the SWZ and in the Proposed Arrangements of the Agreement – Annex No. 2 to the SWZ) and will meet the arrangements of the Parties from the Pre-Implementation Analysis;

3) granting the Ordering Party a license for the System, including the Software necessary for its proper functioning and transferring the author's economic rights to the Dedicated Software (if any) or if this is not possible, in particular in the case of the GPL license – granting the GPL license or other license for copyrighted software with the right to modify the source code;

4) data migration and integration of the System with the systems used by the Ordering Party selected in Appendix No. 1A to the SWZ (SOPZ), in accordance with this Annex and the Pre-Implementation Analysis;

5) preparation and delivery of Documentation to the Ordering Party;

6) conducting training services in the field of operation and administration of the System;

7) launching a fully functional System;

8) providing a guarantee for the System;

9) providing Service Care services to ensure the proper operation of the System in accordance with its intended purpose consisting in maintaining and servicing the System.

Meanings of words, expressions, abbreviations, etc. written in capital letter should also be sought in the proposed Agreement Terms of Annex 2 to SWZ (especially in § 1 PPU — Definitions).

The detailed description and scope of the subject of the order is set out in Annex 1A to SWZ “Detailed description of the subject matter of the order” and Annex 1B to SWZ “Detailed description of the subject of the order — list of open source software”.

The detailed conditions and method of execution of the contract are set out in Annex 2 to the SWZ — the proposed provisions of the contract (hereinafter also referred to as the 'Draft Agreement').

The Ordering Party requires the provision of a guarantee and the provision of Service Care Services / Warranty Service for the System described in detail in Annexes 1A and 1B to the SWZ, including the Software necessary for its proper functioning at least for the period indicated in the order documents. Details of the guarantee, warranty and related benefits are included in Annex 1A to the SWZ and in the Draft Agreement constituting Annex 2 to the SWZ.
