The subject of the contract is the delivery, implementation and maintenance of a platform based on a physical server for the use of software and services for detecting and analyzing threats in the network along with technical support for 36 months in accordance with the requirements set out in Annex 1 to the SWZ – Description of the subject of the contract.
As part of these proceedings, the Contractor is obliged in particular to:
1) provide a subscription to software for detecting and analyzing threats in the network for a period of 36 months,
2) implementation of the provided software
3) providing technical support services in the amount of 8 service hours per month for a period of 36 months
4) provide the Ordering Party with access to technical support
5) conduct training
The validity of the subscriptions and support services provided should cover a period of 3 years from the signing of the acceptance protocol.
1. In the context of these proceedings, the Contractor shall in particular be obliged to:
1) provide a subscription to software for detecting and analyzing threats in the network for a period of 36 months,
2) implementation of the delivered software preceded by a pre-implementation analysis by the Contractor, the result of which will be the development of technical documentation for the implementation. As part of the implementation works, the Contractor will install and configure the system, carry out tests of the implemented software in accordance with the technical documentation of the implementation and conduct training for the Ordering Party's administrators in the administration of the implemented system,
3) providing technical support services in the amount of 8 service hours per month for a period of 36 months. (i.e. a total of 288 service hours) on the terms set out in the OPZ and in § 5 of the Agreement,
4) provide the Ordering Party with access to technical support offered by the entity being the author of the application software on the terms specified by this entity.
The validity of the subscriptions and support services provided should cover a period of 3 years from the signing of the acceptance protocol.
5) conducting once a year a minimum 2-day stationary training (not further than 200 km from the headquarters of the contracting authority) for a group of up to 7 people, the scope including*:
(a)Introduction to the Platform
b) Discuss how to configure and manage the platform.
c) Discussion of the capabilities of the platform and the types of analyses that can be performed.
d)Obtaining the knowledge necessary to detect and analyze threats in the network
e) Acquisition of the ability to use the tools provided by the Contractor
f) Detailed discussion of reporting.
g)Workshops.
h) Issuance of the Certificate of participation and acquisition of skills after the training along with an hourly indication of the subject of the training.
*the total cost of organizing the training belongs to the Contractor.
3. The place of delivery of the software together with the documentation, subscription and provision of services constituting the subject of the Agreement is the seat of the Lubelskie Voivodeship in Lublin, Artura Grottgera 4, 20-029 Lublin.
4.The remuneration for the performance of the subject of the contract will be paid in three tranches, of which the first and second may not exceed 1/3 of the total value of the contract respectively on the following principles:
1) I tranche – will be made within 21 days from the date of delivery to the Ordering Party of the correct invoice issued, after signing the acceptance protocol referred to in § 3 section 1 of the Essential Provisions of the Agreement without comments,
2) tranche II – will be made within 21 days from the date of delivery to the Ordering Party of the correct invoice issued, after at least 12 months from the date of signing the acceptance protocol referred to in point 1 above
3) III tranche – will be made within 21 days from the date of delivery to the Ordering Party of the correct invoice issued, after at least 24 months from the date of signing the acceptance protocol referred to in point 1 above.
5.If the procurement documents indicate trademarks, patents or origin for certain materials or equipment, the Contracting Authority, in accordance with Article 99(5) of the Public Procurement Law, shall allow the offering of equivalent materials or equipment.
6.Whenever the Contracting Authority describes the subject of the contract by reference to standards, European technical assessments, approvals, technical specifications and technical reference systems, it allows solutions equivalent to those described.
