The subject of the order is the supply of electricity in accordance with the provisions of the Act of 10 April 1997. Energy right to the Ordering Party's energy collection points. A detailed description of the item of the order is set out in Annex 2 to the SWZ.

The subject of the contract is the supply of electricity to PPUH “RADKOM” Sp. z o.o. for a period of 12 months (planned start from 01.08.2022r. - 31.07.2023r. within the meaning of the Act of 10.04.1997 Energy Law (Journal of Laws of 2017, item 1579, as amended).

2. Sales will take place through a distribution network owned by PGE Distribution SA as a Distribution System Operator with which the Contracting Authority has contracts (for individual facilities) for the provision of distribution services.

3. The Contracting Authority has a power production concession No WEE/612/11621/W/3/2004/KG and produces electricity in a biogas plant.

4. The Contractor is obliged to purchase the electricity entered into the grid at a contractual price not less than the average selling price of electricity on the competitive market in the preceding quarter, announced by the President of the URE referred to in Article 23 (2) (18a) of the Energy Law.

5. The Contractor shall be responsible for the commercial balancing of electricity and shall relieve the Ordering Party from the obligations relating to imbalances.

6 In order to simplify the rules for accounting for active electricity consumption, the Ordering Party intends to achieve a single fixed price per kilowatt-hour. Therefore, all additional costs and charges related to the implementation of the subject of the contract, including in particular the fixed costs of commercial charges, must be taken into account from the offered unit electricity price.
