The subject of the order is the comprehensive supply of high-methane natural gas (Group E) — the supply of gas fuel together with the distribution service to the Ordering Party's facilities — amounting to 12,176,708 kWh for the planned order between 1.10.2021 and 31.12.2022.
1. The object of the order is the comprehensive supply of high-methane natural gas (Group E) — the supply of gas fuel together with the distribution service to the Ordering Party's facilities - amounting to 12 176 708 kWh for the period 1.10.2021 to 31.12.2022.
2. Group E gas should be delivered round-the-clock to the receipt points listed in Annex No 1 to SWZ, which is an assembly of gas equipment used to connect the internal network owned by the Contracting Authority with the gas network of the system operator.
3. The Contractor will be obliged to ensure the quality standards of the Employer's service in accordance with applicable energy law provisions. It should ensure continuity of deliveries without any interruptions in deliveries, except for the situations described in the Energy Law, IRIESD, tariff and have a reserve guaranteeing continuity of deliveries.
4. The ownership of gaseous fuel is transferred to the Ordering Party after the measurement at the gas meter outlet.
5. The amount of gas consumption for the order shall be 12 176 708 kWh for 15 months for the facilities listed in Annex 1 to SWZ. The gas fuel demand was adopted on the basis of the historical consumption of gaseous fuel and may deviate from the actual use of gaseous fuel, as the quantity of gaseous fuel to be supplied to the Ordering Party cannot be determined in advance. The quantity of the contract does not constitute an obligation on the part of the Contracting Authority to purchase gaseous fuel in the quantity given and may not in any case be the basis of any claim by the Contractor.
6. In the course of execution of the contract, the Contracting Party reserves the right to reduce or increase the total quantity of gas fuel purchased and/or the distribution value of gas fuel purchased in the range: for an increase of up to 20%, for a reduction of up to 30% by the quantity (value) of the order specified in Annex 1 to SWZ (planned order). The existence of the circumstances referred to above shall, accordingly, reduce or increase the remuneration of the contractor due to this Agreement. Changing the amount of gas fuel occurs automatically and does not require a party statement. Under this law, the Contracting Party may add and subtract PPG and amend the distribution parameters of gas, in which case the Contracting Party shall submit a written declaration of will to the contractor to exercise the above right to the extent specified thereby. Changes to the tariff group, in accordance with the rules set out in the tariffs approved by the President of the Energy Regulatory Authority, do not require a declaration of will by the contracting authority. In the event that the contracting person does not exercise the right to reduce or increase the total quantity of gas fuel purchased and/or the distribution value of the gas fuel purchased in the range: for an increase of up to 20%, for a reduction of up to 30% relative to the contract quantity of the planned contractor does not are entitled to no claim in this title.
7. Settlements for the sale and distribution of gaseous fuel will be carried out on the basis of current indications of the measurement and settlement system (data provided by the operator of the distribution system hereinafter referred to as' osd '), in accordance with the billing periods resulting from the current tariff of the settlements, which, for tariffs with the number of readings in year 1 and 2, it is possible to settle on the basis of estimated (forecast) consumption — at the request of the Contractor, lodged on the date of conclusion or application of the contract for the comprehensive supply of natural gas with the Contractor presented in this proceeding. In this case, the final settlement for the settlement period shall be based on the billing invoice issued by the Contractor after the measurement data has been obtained from the DSO, which shall take into account the quantity of the gas fuel actually collected by the Contractor.
