Description:
Reception and development of municipal waste from owners of property where residents live from the territory of the Commune Żychlin

1. The subject of the contract is the provision of a service for the collection and management of municipal waste from the territory of the Municipality of Żychlin, including:

(a) Reception of municipal waste from the property on which the inhabitants reside, located in the municipality of Żychlin,

b) Transport of municipal waste from the territory of Żychlin Municipality to the site of their development,

(c) Development of municipal waste received from the territory of the Żychlin Municipality.

2.This procedure is conducted under an open tender procedure pursuant to Article 132 of the Act of 11 September 2019. Public Procurement Law (Journal of Laws of 2021, item 1129, as amended)

1. The subject of the contract is the provision of a service for the collection and management of municipal waste from the territory of the Municipality of Żychlin, including:

(a) Reception of municipal waste from the property on which the inhabitants reside, located in the municipality of Żychlin,

b) Transport of municipal waste from the territory of Żychlin Municipality to the site of their development,

(c) Development of municipal waste received from the territory of the Żychlin Municipality.

2.Basic rules for collecting municipal waste from the żychlin commune.

2.1. Collection of municipal waste generated in the Żychlin commune, coming from the owners of real estate on which residents live. On the day of signing the contract, the Contractor will receive from the Ordering Party a detailed list of properties / address points from which municipal waste will be collected. During the performance of the contract, the list will be updated on an ongoing basis (by the Ordering Party and the Contractor).

2.2.The Contractor is obliged to collect and manage the municipal waste listed in the table below from the areas of inhabited real estate:

3. The Contractor is obliged to receive municipal waste:

(a) continuously, not interfering with night rest (from 6.00 to 22.00),

(b)within the time limits set in the timetable by the exporting undertaking, taking into account the frequencies set out in point 5,

(c) irrespective of weather conditions,

(d) vehicles adapted to receive individual waste fractions, in a way that excludes mixing selectively collected municipal waste with mixed municipal waste.

4. The Contractor is obliged to collect all municipal waste specified in Table 1 in an unlimited amount directly from the area of inhabited properties collected in containers and / or bags meeting the minimum requirements set out in the "Regulations for maintaining cleanliness and order in the Municipality of Żychlin" in accordance with the applicable Resolution No. XV/66/2019 of the City Council in Żychlin of 25.11.2019, as amended, it is the responsibility of the property owner to ensure that the employees of the exporting undertaking have free access and access to the containers and bags on the dates of waste collection.

5.The Contracting Authority requires, in accordance with Article 95(1) of the PPL Act, that the Contractor or Subcontractor employ persons performing activities in the field of contract performance on the basis of an employment contract. A detailed description of employment is described in Chap. IV point 2 of the SWZ.

5.The Contractor may entrust the execution of part of the contract to a subcontractor(s).

6. The Ordering Party does not reserve the obligation of the Contractor to personally perform key parts of the contract.

7.The Contracting Authority requires that in the case of entrusting part of the contract to subcontractors, the Contractor indicates in the tender the parts of the contract whose performance it intends to entrust to subcontractors and provide (if they are known to it at this stage) the names (companies) of these subcontractors. You must fill in the appropriate point of the offer form. If the Contractor leaves this point unfilled, the Ordering Party will consider that the order will be performed by its own forces, i.e. without the participation of subcontractors.

8. Entrusting part of the contract to subcontractors does not release the Contractor from responsibility for the proper performance of the contract.

9.In accordance with Article 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine, it is prohibited to perform a public contract involving subcontractors, suppliers or entities whose capacities are relying on within the meaning of Directive 2014/24/EU where they account for more than 10% of the contract value.
