Comprehensive supply of high-methane natural gas type E for the facilities of the Mszana Municipality and its organizational units

The subject of the contract is a comprehensive supply of high-methane natural gas type E, including the purchase and provision of gas distribution services for the facilities of the Mszana Commune and its organizational units. The order is covered by 11 points. The total estimated amount of gaseous fuel that will be delivered during the contract period is 2560156 kWh, of which 1466173 kWh will be settled on the basis of prices resulting from the Act of 26 January 2022 on special solutions for the protection of gas fuel customers in connection with the situation on the gas market (Journal of Laws of 2022, item 202), provided that the Contractor's offer price is higher than the prices resulting from the above-mentioned Act. Values are estimates and are subject to change. In the event of a difference between planned and actual consumption, the Contractor shall not assert financial claims other than those resulting from the amount of gas consumed, and the Contractor's remuneration will be reduced or increased accordingly. Detailed information can be found in Annex 1 to swz.

1. The subject of the contract is a comprehensive supply of high-methane natural gas type E, including the purchase and provision of gas distribution services for the facilities of the Municipality of Mszana and its organizational units.

2. The subject of the contract must meet the requirements set out in the following legal regulations:

1) Act of 10 April 1997 Energy Law (i.e. Journal of Laws of 2021 item 716 with ism)

2) Announcement of the Minister of Energy of 16 May 2018 on the publication of a uniform text of the Regulation of the Minister of Economy on the detailed conditions for the operation of the gas system (Journal of Laws of 2018, item 1158)

3) Regulation of the Minister of Energy of 22 September 2019 amending the Regulation on detailed rules for the formation and calculation of tariffs and settlements in the trade in gaseous fuels (Journal of Laws of 2019, item 1904)

4) Act of 26 January 2022 on special solutions for the protection of gaseous fuel customers in connection with the situation on the gas market (Journal of Laws of 2022, item 202)

5) Act of 6 December 2008 on excise duty (i.e. Journal of Laws of 2022, item 143, as amended).

3. The contract covers 11 gas collection points – in accordance with Annex 1 to the SWZ. The total estimated (forecasted) amount of gaseous fuel that will be delivered during the term of the contract (12 months) to the collection points is 2560156 kWh, of which 1466173 kWh will be settled on the basis of prices resulting from the Act of 26 January 2022 on special solutions for the protection of gas fuel customers in connection with the situation on the gas market (Journal of Laws of 2022, item 202), if the Contractor's offer price is higher than the prices resulting from the above-mentioned Act. The above values are estimates and are subject to change. In the event of a difference between planned and actual consumption, the Contractor shall not assert financial claims other than those resulting from the amount of gas consumed, and the Contractor's remuneration will be reduced or increased accordingly.

4. The Contractor shall perform all actions and arrangements with the DSO necessary to carry out the procedure of changing the seller and effectively start the sale of gaseous fuel, including in particular: notification to the DSO of a new comprehensive contract for the sale of gaseous fuel.

5. The supply of gaseous fuel will take place on the basis of one comprehensive contract.

6. The consumption of gaseous fuel for all gas intake points shall be exempt from excise duty.

7. Tariff protection – annex no. 1 to swz indicates collection points where gas fuel customers are entitled to benefit from tariff protection in accordance with the Act of 26 January 2022 on special solutions for the protection of gaseous fuel customers in connection with the situation on the gas market (Journal of Laws of 2022, item 202).

8. Detailed information on individual points of consumption, tariff group, contractual capacity and planned amount of gaseous fuel consumption are presented in the summary list constituting Annex 1 to swz.

9. The costs of using the subject of the contract consist of: a fee for the sale of gas, a subscription fee, a fixed distribution fee and a variable distribution fee.

10. The Contractor must have a current contract with the Distribution System Operator (unless it is the operator itself), operating on the premises of the Ordering Party and enabling the sale of gas fuel via the distribution network to the Ordering Party's collection points. The Distribution System Operator is Polska Spółka Gazownicza sp. z o.o. Branch in Zabrze.

11. Pursuant to Article 246(2) of the PPL Act, the quality requirements relating to the main elements constituting the subject of the contract were specified by the Contracting Authority in the description of the subject of the contract contained in the draft provisions of the contract.

12. In view of the subject-matter of the contract, Article 100(1) of the PPL act does not apply in the present proceedings.

13. It does not specify the requirements of Article 95 and Article 96(2) of the PPL.
