1. The subject of the order is delivery and installation: for households located in the municipality: 173 pcs of photovoltaic installations with a total power min. 0.74594 MW/e, 38 solar collector installations with a total power of 0.16409 MW/t
for households located in Komorniki: 184 pieces of photovoltaic installations with a total capacity of 0.817 MW/e, 18 solar collector installations with a total power of 0,079355 MW/t.
2. The obligations of the Contractor also include completing comprehensive design documentation of solar installations.
3. A detailed description of the subject of the contract is provided in the Functional and Utilities Programme (hereinafter PFU), annex 1 of the proposed provisions of the contract.
4. Any requirements set out in the above documents constitute minimum requirements and their fulfilment shall be mandatory. Failure to comply with the above requirements will result in rejection of the offer as incompatible with the terms of the order.
4. The main objective of the project is to increase the use of renewable energy sources and reduce air pollution emissions in Komorniki and Dopiewo Municipality through the installation of modern RES installations on propertys/residential buildings or the ground. Implementation of the project will benefit the quality of the environment, contribute to reducing CO2 emissions and other pollutants, which will improve air quality and in the long term will translate to improving the quality of life of residents, their health status, and reduce occurrence of the greenhouse effect.
5. The Contractor shall be obliged to achieve the indicators described in the PFU, annex 1 of the proposed provisions of the contract, and to report these indicators within 15 December of each year for a period of 5 full years starting from the following year in which it was signed final protocol of completed works without observations of the work performed and at the request of the Contracting Party within 5 working days.
6. The Contractor will supply the object of the order factory new (applies to any equipment and materials), unused, technically efficient, without physical or legal defects. All devices constituting the subject of the contract should be ready for operation, come from current production, from a legitimate source of distribution and have a manufacturer's warranty enabling the realization of warranty entitlements within the territory of Poland.
7. Pursuant to Article 101 (4) of the Pzp Act, the Contracting Authority shall allow solutions equivalent to those described in the SWZ by means of standards, technical assessments, technical specifications and technical reference systems referred to in Article 101 (1) (2) and paragraph 3 of the Act if they allow to obtain characteristics or parameters no worse than recalled.
8. Pursuant to Article 101 (5) of the Pzp Act, a Contractor who invokes solutions equivalent to those described by the Contracting Authority, is obliged to prove by attaching to the offer the relevant means of evidence referred to in Articles 104-107 of the Pzp Act that the proposed solutions to an equivalent extent meet the requirements set out in the description of the subject matter of the contract.
9. The Contractor shall be obliged for the entire period for which the Agreement is concluded, hold liability insurance in the scope of the business carried out related to the subject of the contract for a guarantee sum not less than 5 000 000,00 PLN valid no later than PLN 5 000 000,00 valid no later than from the date of signing the contract until the final receipt.
10. If the Contractor fails to submit the means of evidence in question or the evidence submitted in question are incomplete, the Contracting Authority shall call for them to be lodged or supplemented within the deadline set.
