The subject of the contract is the performance of a service consisting in the analysis of design documentation, analysis of the Contract template for the execution of construction works, supervision over the implementation of construction works and management of the investment entitled "Construction of transshipment capacity of the seaport in Świnoujście to service the needs of offshore wind energy" and conducting on behalf of and for the benefit of the Contracting Authority Environmental Supervision during the implementation of the Investment.For the purposes of the implementation of this contract, the contractor will be required to act as an Engineer for the purposes of the Contract carried out in accordance with the Contract Conditions according to FIDIC - CONTRACTUAL CONDITIONS FOR CONSTRUCTION for engineering and construction works designed by the contracting authority".

The subject of the contract is the performance of a service consisting in the analysis of design documentation, analysis of the Contract template for the execution of construction works, supervision over the implementation of construction works and management of the investment entitled "Construction of transshipment capacity of the seaport in Świnoujście to handle the needs of offshore wind energy" and conducting on behalf of and for the benefit of the Contracting Authority Environmental Supervision during the implementation of the Investment, in particular:

a) analysis of the final state of Drawings, Specifications, Bills of Quantities and all studies prepared by the Designer for the purpose of preparing the Report for Drawings and Specifications,

b) analysis of the final status of the Contract template for the purpose of preparing the Report for the Contract template,

c) giving opinions and managing the Contractor's Documents and Documents,

d) coordinating and supervising the implementation of construction works, services and supplies carried out by the Contractor in the scope of the Investment and exercising control over the performance of author's supervision carried out by the Designer,

e) monitoring the progress of the Works by checking their actual progress and compliance with the Implementation Schedule applicable during the implementation of the Contract;

f) supervising compliance with health and safety rules and legal regulations regarding Investments,

g) administration and management of the Contract,

h) supervising compliance with the Investment budget provided by the Contracting Authority,

i) settlement of the Contract,

j) supervision over the removal of defects in the subject of the Investment,

k) conducting all activities resulting from the performance of the Engineer's function in accordance with the Contract. To the extent described in the Agreement, before issuing a decision, the Engineer is obliged to obtain the written consent of the Ordering Party,

l) performing on behalf of and for the benefit of the Ordering Party activities of Environmental Supervision, in accordance with Decisions, Documents and provisions of the Agreement,

m) performing any other activities related to the supervision, administration, management and/or control of the Investment, including in particular coordination necessary to perform tasks under the Investment,

n) cooperation with the contract engineer acting on behalf of Orlen Neptun II and with Orlen Neptun II in the implementation of the Project. Cooperation in the scope described in the previous sentence will be carried out in particular with regard to the coordination of Works carried out at the junction of the scope of the ZMPSiŚ Investment and the scope of the Orlen Neptun II investment,

o) cooperation with Orlen Neptun II in the manner provided for in the law for the implementation of the Project,

p) performing the duties of a supervision inspector in accordance with the provisions of applicable law,

q) performing the duties of the Engineer during the Defect Reporting Period.

For the purposes of performing this contract, the contractor will be required to act as an Engineer for the purposes of the Contract carried out in accordance with the Contract Conditions according to FIDIC - CONTRACTUAL CONDITIONS FOR CONSTRUCTION for engineering and construction works designed by the contracting authority", 4th English-Polish unchanged edition 2008 with errata (translation of the 1st edition 1999), prepared and published by the International Federation of Consulting Engineers (Fédération Internationale des Ingénieurs - Conseils - FIDIC, P.O. Box 311, CH-1215 Geneva 15, Switzerland) - amended by the content of the Special Conditions and supplemented with any other documents specifying the Investment and the conditions for its implementation, including in particular Decisions and Documents defined in § 1 clauses 5 and 6 of the draft Agreement and in accordance with the provisions of Polish law. The detailed scope of the service is specified in the Description of the subject of the contract and the draft Agreement, which constitute annexes to the SWZ.

The criteria for the evaluation of tenders are: Price 80% and Substitution of Key Engineer Personnel 20%. The highest number of points (S) determines the recognition of the offer as the most advantageous. S (sum) = Price 80 % + Substitution of Key Engineer Personnel 20 %
