1. The subject of the contract is the Delivery of server cabinets for the TASK IT Center.

2. The basic order includes the delivery of 20 pieces of 800 server cabinets with the specification of the above-mentioned description of the subject of the contract constituting Annex 4 to the SWZ and their assembly in designated server chambers of the Ordering Party.

3.The contracting authority provides for the exercise of the right of option consisting in a possible increase of the basic contract by a maximum of 6 pcs. server racks. If the option right is exercised, the Contracting Authority shall place an additional order according to Annex 2 to the model contract within 4 months from the date of conclusion of the Agreement, and the Contractor shall be obliged to deliver the subject of the optional contract within the delivery period specified in Chapter IV, paragraph 3 of the SWZ.

4.Detailed requirements regarding the subject of the contract are included in the description of the subject of the contract constituting Annex 4 to the SWZ.

5. The Offer submitted by the Contractor must be unambiguous and comprehensive, i.e. cover the entire subject of this contract. The subject of the contract offered by the Contractor must be complete with all components, parts and materials necessary for commissioning and use, described in Annex 4.

6.In order to fulfil its obligations, the Contractor should provide experienced and qualified persons capable of carrying out all entrusted tasks, conditioning the proper implementation of the subject of the contract.

7.The Contractor is obliged to perform the contract on the terms and conditions described in the model contract constituting Annex 3 to the SWZ.

8.The Contractor is obliged to clearly identify the offered products, characterizing them by indicating in the table contained in the offer form, constituting Annex 1 to the SWZ, the required information enabling identification of the offered subject of the contract. The contracting authority requires the contractor to submit together with the tender the means of proof used to confirm the compliance of the offered subject of the contract with the requirements and characteristics specified in the description of the subject of the contract

9. The subject of the contract must be brand new, without prior operation, technically efficient, free from legal and physical defects, will comply with the recommendations, standards and applicable technical and operational requirements in force in the Republic of Poland, and the services will be performed with the utmost care.

10. The Contracting Authority requires the Contractor to deliver the subject of the contract to the headquarters of CI TASK in Gdańsk at its own expense, within the time limit agreed with the Contracting Authority. Liability and all risks until delivery to the Ordering Party shall be borne by the Contractor. The subject of the Agreement will be delivered to the server room in the newly built building of CK STOS of the Gdańsk University of Technology, at Traugutta Street in Gdańsk. The costs of transport, packaging, insurance for the time of transport, storage in the place indicated by the Ordering Party and cleaning up the area after delivery shall be borne by the Contractor.

11. The Contracting Authority requires the Contractor to grant a minimum of 24 months of guarantee and warranty for the subject of the contract counted from the date of signing the handover and acceptance protocol without reservations.
