1. Object of the order:

Comprehensive supply of high methane natural gas (Group E) including sales

and gas distribution for the needs of Przedsiębiorstwo Komunikacji Miejskiej Sp. z o.o. in Tychy. The Ordering Party informs that the gaseous fuel will be intended to power internal combustion engines

and is therefore subject to a rate of 0% excise duty.

2. PLACE OF ORDER EXECUTION:

The collection point together with the reduction and measurement station are located in the depot of Przedsiębiorstwo Komunikacji Miejskiej Sp. z o.o. in Tychy, Ul. Towarowa 1, 43-100 Tychy.

3. ANTICIPATED QUANTITY:

The expected amount of gaseous fuel ordered is 500,000 Nm3.

Detailed data on the planned gas consumption in individual months for Przedsiębiorstwo Komunikacji Miejskiej Sp. z o.o. in Tychy is included in Annex 1 to OPZ.

4. PRICE COMPONENTS:

The gross offer price is the offer price, which includes all costs associated with delivery

and distribution, including purchase, transmission, contractor's profit, all applicable taxes and fees, including VAT, and any costs associated with the correct

and timely execution of the order, as well as any additional fees applied by fuel sellers.

The offer should include all components of the price according to Annex 2 to the SWZ – FORM

5. VALUE ADDED TAX

The contracting authority informs that the VAT rate applicable on the date of submission of the offer should be used to calculate the price of the offer.

6. PRICE CHANGE

Does the contracting authority allow changes in unit prices only in the event of changes in the law independent of the Contractor? In particular, we are talking about the change in the amount of: excise tax, VAT, network rates (fixed and variable network fee) of the Distribution System Operator (DSO) tariff.

7. DESCRIPTION OF THE INFRASTRUCTURE OWNED:

Used CNG compressor with 600 Nm3/h capacity including the following components:

- piston-crank system, body - year of manufacture 1987,

- lubrication system with oil dosing system - year of manufacture 2006,

- main drive engine 160 kW - year of manufacture 2017,

- compressor clutch / shaft - year of manufacture 2017,

- power system - modernization in 2017,

- control and protection system – modernization in 2017,

- container housing of the compressor type EPS SYSTEM - year of manufacture 2018, - a set of documentation.

- gas dryer for installation at the inlet to the compressor (for supply 3-4 bar), year of manufacture 2017,

8. DEADLINE FOR IMPLEMENTATION:

From 01.07.2023, for 12 months, i.e. until 30.06.2024.

The Ordering Party reserves the right to change the duration of the fuel delivery period

depending on your needs. A change in the date of fuel delivery by the Ordering Party may not be the basis for financial claims of the Contractor. The contracting authority informs that it is not subject to the Act

on special solutions to protect customers of gaseous fuels in connection with the situation on the gas market (Journal of Laws of 2022, item 202).

9. CONCLUSION OF THE AGREEMENT

The Ordering Party allows the conclusion of the contract in the form of correspondence or electronic

with the use of a qualified electronic signature.

10. NOMINATIONS AND RE-NOMINATIONS OF GASEOUS FUEL

The Contracting Authority informs that the obligation to submit weekly nominations and Nominations

and Daily Renominations of gaseous fuel rests with the Contractor.

11. ACT ON SPECIAL SOLUTIONS FOR THE PROTECTION OF CUSTOMERS OF GASEOUS FUELS.

The Contracting Authority informs that it is not protected in the light of the Act on special solutions for the protection of gas fuel consumers in connection with the situation on the gas market (Journal of Laws of 2022, item 202) in force from 26 January 2022.
