Description:
Supply of electronic equipment as part of the investment task "Construction of a kindergarten at ul. Myśliborska 35 ", implemented by the Office of the Białołęka District of the Capital City of Warsaw.

1. The subject of the contract is the delivery of electronic equipment intended for Kindergarten No. 428 at ul. Myśliborska 35 in Warsaw (hereinafter referred to as the "Facility") together with software and licensing, as well as comprehensive configuration, commissioning and training, as described in Annex 1 to the contract (Description of the subject of the contract) and in accordance with the unit prices specified in Annex 2a to the contract (Price form including the result of the auction), as part of the investment titled "Construction of a kindergarten at ul. Myśliborski. "

2. The material scope of the Subject of the contract includes in particular:

1) delivery of electronic equipment covered by the contract in accordance with the Supplier's offer and its annex with the technical parameters of the equipment offered and indication of the manufacturer and model of the given range of equipment - Annex 1a to the contract (including purchase / production cost), transport insurance, loading, unloading , bringing, arranging in individual rooms of the kindergarten facility and assembly in relation to wall mounts for multimedia boards / wall and ceiling mounts for projectors - in accordance with the description of equipment arrangement set out in Annex 3 to the contract;

2) providing software on CD / DVD media and granting the necessary licenses or confirming software licenses, unless these licenses are granted to the Ordering Party / facility user directly by the manufacturer;

3) software installation, comprehensive configuration (including such configuration that will allow printing to a network printer from any networked computer provided under this agreement) and commissioning of electronic equipment - completed by carrying out control tests confirmed by protocol;

4) providing documentation (operating instructions, technical and operational documentation) - including in Polish;

5) cleaning the premises (places related to ongoing works) - after the Subject Matter of the contract has been arranged in the facility;

6) one-day training of selected user employees on the operation of the supplied hardware and software for 4 hours. The training will take place after conducting control tests of the equipment, on a date agreed with the User of the facility and in the place indicated by the User of the facility;

7) quality guarantee granted for the period resulting from the supplier's offer (not shorter than specified in § 7 paragraph 1 of the contract and description of the subject of the order, Annex 1 of the contract) for the equipment supplied and on conditions not worse than the manufacturer's warranty, confirmed by a separate guarantee document.

3. The subject of the contract should be brand new, undamaged, free from defects, complete, fit for its proper operation - in accordance with the functional scope and its purpose specified in Annex 1 to the contract (Description of the subject of the contract), also marked with the CE mark (Conformité Europe ), have appropriate approvals, declarations of compliance security certificates - with applicable standards and regulations. Equipment should be delivered with intact warranty seals.

4. The Supplier undertakes to perform the Subject of the contract with the utmost diligence, in accordance with applicable regulations, standards, principles of technical knowledge and to ensure the highest quality of work accompanying the delivery.

5. The Supplier declares that he has acknowledged that the works related to the Subject of the contract will be carried out in the Facility being in use, and also ensures that he has the appropriate technical preparation and has access to the equipment that will allow the performance of the Subject of the Contract in accordance with the applicable regulations and norms.

6. Responsibility for Equipment Items up to the date of final acceptance of the Subject of the Contract rests solely with the Supplier. If the Supplier does not foresee delivery and installation within one day, the Supplier is fully responsible for the loss or destruction of the subject of electronic equipment covered by the Subject of the contract also in the situation when the equipment was assembled on site.

7. The Supplier may not entrust, in whole or in part, the performance of the Subject Matter of the contract to third parties without the prior written consent of the Employer. The Supplier bears full responsibility towards the Employer / User for the works he performs with the help of subcontractors. The supplier undertakes to pay subcontractors remuneration based on their legal relationship.
