1. The subject of the contract is the delivery with the implementation of a redundant matrix for a backup server room.
2. A detailed description of the subject of the contract is contained in the model contract with attachments, constituting Annex 9 to the SWZ.
3. These proceedings are proceeded, in accordance with the Act of 11 September 2019 – Public Procurement Law (i.e. Journal of Laws of 2022, item 1710), hereinafter referred to as the "Act", in the form of an unlimited tender, using the so-called "reverse procedure" described in Article 139 of the Act, with the proviso that each Contractor is obliged to submit together with the offer the statement referred to in point 6.1.6. SWZ.

3. The Ordering Party shall not allow the submission of partial tenders. Justification for not dividing the contract into lots:
The subject-matter of the contract cannot be divided into parts for technical, teleological and economic reasons, since it constitutes a coherent whole. All elements of the order are related and affect the quality of the solution and its implementation or feasibility. The lack of division into lots does not limit access to the contract for small and medium-sized enterprises, and Contractors operating in the industry covered by the subject of the contract may provide all its elements.
4. The Contracting Authority does not require the execution of the contract by protected work establishments, social cooperatives or other contractors subject to the provision of Article 94 (1) of the Act.
5. The Ordering Party does not require the employment of persons on the basis of an employment relationship.
6. The Contracting Authority does not provide for the possibility of awarding contracts referred to in point 8 of Article 214 (1) of the Act.
7. The Contracting Authority shall not permit the submission of variant tenders.
8. The Awarding Entity does not envisage conducting an electronic auction.
9. The Contracting Authority did not conduct preliminary market consultations prior to the initiation of the procedure.
10. In this proceeding, the Contracting Authority shall require the Contractors to submit the means of proof referred to in point 6.1.7.
11. The Contracting Authority, within the limits set out in Article 462 et seq. of the Act, allows the possibility of performing the subject of the contract by the Contractor with the use of subcontractors. A contractor who intends to entrust the performance of part of the contract to subcontractors shall indicate in the tender the parts of the contract which it intends to entrust to subcontractors and give the names of any subcontractors, if they are already known.
12. The Contractor, before the deadline for submitting tenders, is obliged to lodge a security in the amount of: PLN 20,000.00 and maintain it indefinitely until the date of expiry of the deadline for binding the offer, except in the cases referred to in Article 98(1)(2) and (3) and (2) of the Act. The details of the lodging of the security are described in point 13 of the SWZ.
