Receipt and use of biodegradable waste code 20 02 01 from the Transshipment Station in Medynach gm. Lidzbark Warmiński

The subject of the contract is the service of collection and management of biodegradable waste with code 20 02 01 in a way that ensures the transfer of responsibility for waste management to the next waste holder.

1. The subject of the contract is a service for the collection and handling of biodegradable waste with code 20 02 01 in a way that ensures the transfer of responsibility for waste management to the next waste holder.

2. The amount of waste with the code 20 02 01 intended for collection and management under the basic order is up to 1000Mg, with up to 500Mg in the bag system and up to 500Mg in the bagless system.

3. The Ordering Party has no influence on the size of the waste stream received, due to the high variability of this stream. Therefore, the Contracting Authority, as part of this contract, allows the exercise of the option right referred to in Article 441(1) of the Public Procurement Law. The contracting authority may exercise the right of option in whole or in part, once or in several parts. An option is envisaged to increase the amount of waste to be received and managed with code 20 02 01 additionally to 2,400 Mg, with up to 1,200Mg in the bag system and up to 1,200Mg in the bagless system.

4. The Contracting Authority shall exercise the right of option if there is a demand for further implementation of the above services.

5. The maximum possible scope of the order if the Ordering Party exercises the option is up to 3,400 Mg, including: up to 1,000 Mg under the basic order (500Mg in the bag system and 500Mg in the bagless system) and up to 2,400 Mg under the option (1,200Mg in the bag system and 1,200Mg in the bagless system).

6. The Contractor will collect the above-mentioned waste from the Contracting Authority from the Reloading Station (hereinafter: SP) in Medyny 51, Lidzbark Warmiński commune.

7. Biodegradable waste (20 02 01) – municipal waste collected in accordance with the guidelines of the Ministry of Climate and Environment, i.e. m.in the so-called green waste and food residues from households and housing estates collected by residents or security services in bulk or in bags – in accordance with local regulations for maintaining cleanliness and order in the Company's home municipalities.

8. In addition, bio-waste with code 20 02 01 will be delivered in a bag or bagless system.

9. Waste with the code 20 02 01 is collected at the reloading station in boxes – collection takes place within 48 hours from the date of notification of the demand for collection by the Ordering Party. Loading on the side of the Ordering Party.

10. Waste collected from the Ordering Party shall be transferred to the entity having a decision specified in Article 27 paragraph 2 point 1 or 2 of the Act of 14 December 2012 on waste indicated by the Contractor before signing the contract.

11. Bio-waste will undergo aerobic or anaerobic treatment resulting in compost, digestate or other non-waste material or substance.

12. The obtained compost, digestate or other material will be used as a product, material or substance and placed on the market as a fertilizer or soil improver on the basis of the permission of the minister competent for agriculture (certificate).

13. Due to the subject matter, the order must be carried out, in particular in accordance with the above. Provisions:

1) the Waste Act of 14 December 2012;

2) the Act of 27 April 2001 Environmental Protection Law;

3) Act of 13 September 1996 on the maintenance of cleanliness and order in municipalities

and other laws and regulations applicable to the subject of the contract.

14. Due to the fact that the Ordering Party has no influence and is not responsible for the quantities of waste sent to its installations and their quality, they are not guaranteed by the Ordering Party.

15. For settlements between the Parties, the amount of waste collected will be determined by measurement on the electronic truck scale of the Ordering Party.

16. The transfer of waste will be confirmed by means of a waste transfer card – in accordance with applicable regulations.
