1. Description of the subject of the contract:
a) The subject of the contract is a service consisting in the maintenance, maintenance and repair of tram infrastructure in Krakow from 1/11/2018 to 30/09/2019.
b) The contractor is obliged to provide: 36 months warranty.
c) The subcontract, the object of which are services, should be in accordance with Annex 2 to the ToR, i.e. a model contract. Failure to meet the conditions relating to subcontractors contained in the model contract will result in the Employer raising objections or objections, respectively.
d) Date of contract performance: from 1/11/2019 to 30/09/2019.
1. Description of the subject of the contract:
a) The subject of the contract is a service consisting in the maintenance, maintenance and repair of tram infrastructure in Krakow from 01/01/2019 until 30/09/2019. The scope of work includes, among others:
• maintenance, conservation, repairs:
- tram tracks,
- traction network, drives, switches and switches heating, tram detection elements working in road signaling systems,
- traction substations and cable system.
• conducting Power System Instructions,
• performing periodic inspections,
• performing emergency repairs:
- tram tracks,
- traction network, drives, switches and switches heating, as well as tram detection elements working in road signaling systems,
- traction substations and cable system.
The contracting authority described the subject of the contract using a technical specification with attachments - Annex 5 to the ToR.
2. In the event of any trademarks, standards, approvals, technical specifications and reference systems appearing in any Annex to the ToR, products may be replaced by equivalent ones. The Employer will consider as equivalent solutions such solutions that allow achieving the effect assumed by the Employer through other technical solutions. An identical (identical) solution cannot be considered equivalent, but only those which in the compared features indicate exactly the same or very similar utility value. By indicating the manufacturer's names, trademarks, standards, approvals or reference systems, the Employer aimed to define the minimum quality parameters and functional characteristics that the goods must meet to meet the requirements set by the Employer and constitute only a quality standard of the subject of the contract. By the entry regarding the minimum requirements of quality parameters, the Employer understands the requirements of the goods contained in publicly available sources, catalogs, manufacturers' websites, etc. Using sample manufacturer's names is only to clarify the level of expectations of the Employer in relation to a specific solution.
3. Before signing the contract, the Contractor is obliged to provide a security on due performance of the contract in the amount of 5% of the total price given in the offer.
4. The contractor must have a technical and administrative base within the boundaries of the Krakow City Commune, enabling the implementation of the subject of the contract.
5. The Contractor on the day of conclusion of the contract will submit to the Employer the following documents:
1) insurance policies in the form of copies of these documents certified as true copies,
2) confirmation of the timely payment of the insurance premium in the form of copies of these documents certified as true copies,
Confirming that the Contractor has civil liability insurance in connection with the conducted economic activity covering the Subject of the contract. In justified cases, the Employer is entitled to request from the Contractor the originals of submitted documents. During the term of the Agreement, the Contractor is required to have valid civil liability insurance covering the entire scope of activity based on this Agreement with a guarantee sum of not less than PLN 1,500,000.00 (in words: one million five hundred thousand 00/100) for one and all insured events excluding franchises.
6. For transfer PLN value in doc. compound on confirmation satisfy. war. participation in post., expressed in currencies other than PLN, order will adopt the average public course through Nar. Bank of Poland, table A, of the public announcement of the order in DUUE. If on this day the course is not announced, for the above mentioned ge. will be the last public course before this day.
