The subject of the contract is a comprehensive supply of electricity, including the sale of electricity and the provision of electricity distribution services up to 51 points of energy consumption, for the purposes of the Department of Water and Sewers Municipal Enterprise Gospodarki Komunalna Sp. z o.o. in Stargard, between 01.01.2022 and 31.12.2024

1. The object of the contract is a comprehensive supply of electricity, including the sale of electricity and the provision of electricity distribution services up to 51 points of energy consumption, for the purposes of the Department of Water and Sewerage of the Municipal Enterprise Komunalna Economy Sp. z o.o. in Stargard, between 01.01.2022 and 31.12.2024

2. Comprehensive supply of electricity and distribution services will be carried out within the meaning and under the conditions laid down by the provisions of the Act of 10 April 1997 — Energy Law — (Journal of Laws of 2012, item 1059 as amended) and in accordance with the provisions of the Act of 10 April 1997 — Energy Law — (Journal of Laws of 2012, item 1059 as amended) and in accordance implementing, in particular, with the quality standards of the recipients defined

in the Ordinance of the Minister of Economy of 18 August 2011 on detailed rules for the formation and calculation of tariffs and settlements in the trading of electricity (Journal of Laws 2011 No. 189, item 1126).

3. Planned amount of electricity during the term of the contract: 12403,60 MWh.

4. The value of electricity demand indicated above is an estimate. The Contracting Authority declares the use of electricity for the duration of the contract at a minimum level of 10000 MWh. Actual settlements will take place on the basis of current indications of measurement systems — billing for the supply of electricity, as offered by the Contractor, for the distribution of electricity will be based on charges arising from the Tariff of the Distribution System Operator.

5. Electricity supplies for new electricity consumption points not covered by Annex No 4, where there has been a significant increase in power in connection with the expansion made, will be made on the basis of an amendment of the Annex in question, in accordance with the unit prices shown in Attachment to the offer.

6. The Contractor under the task shall be obliged to speak on behalf of the Contracting Authority,

on the basis of the power of attorney granted, the existing contracts for distribution services for energy collection points and the sale of electricity. The Contractor shall also receive an appropriate power of attorney to notify the Distribution System Operator of the conclusion of a comprehensive contract for the sale of electricity.

7. The price of electricity during the term of the contract is to be fixed and will not be increased,

except in accordance with Article 436 (4) of the Law Pzp.

8. The Contracting Authority allows modification of the tariff group applicable to the object concerned, only within the tariff groups covered by the contract.
