The subject of the contract is the delivery and installation of elements of data storage systems and the integration of these elements with the ICT infrastructure already in place at the contracting authority for the purposes of the implementation of the NEBI and ECBIG-MOSAIC projects - in accordance with the requirements of the contracting authority specified in the Detailed requirements for the subject of the contract (Part IV of the Terms of Reference). The order has been divided into the following parts:
Part 1: Delivery and installation of data storage system components and integration of these elements with the NEBI infrastructure already in place at the Laboratory for Modelling and Visualization of the Dynamics of Complex Biological Processes;
Part 2: Supply and installation of data storage system components and integration of these elements with the already existing virtualized ICT infrastructure for data integration and analysis using AI for Module III and virtualized ICT access infrastructure for Module IV of the platform in the ECBIG-MOSAIC project
Part 11. The subject of the contract is the delivery and installation of elements of data storage systems and integration of these elements with the ICT infrastructure already in place at the contracting authority for the purposes of the implementation of the NEBI and ECBIG-MOSAIC projects - in accordance with the requirements of the contracting authority specified in the Detailed requirements for the subject of the contract (Part IV of the Terms of Reference). Part 1: Delivery and installation of data storage system components and integration of these elements with the NEBI infrastructure already in place within the Laboratory of Modelling and Visualization of the Dynamics of Complex Biological Processes.
2. Detailed requirements regarding the subject of the contract are an integral part of the description of the subject of the contract and are included in Part IV of the SWZ - respectively for each of the above-mentioned parts of the contract, where, in accordance with Article 99 paragraph 6 of the PPL Act, the contracting authority indicated the criteria used to assess equivalence.
3. The Contractor is obliged to provide the contracting authority with a quality guarantee and is obliged to perform the services resulting from it. The warranty requirements are set out in Parts III and IV of the Terms of Reference for each of the above-mentioned parts of the contract, respectively.
4. The delivered item of the order must be factory new, not displayed in exhibitions, complete and technically operational. The statement 'factory new' shall mean the item of the order originally packaged, not used before the date of delivery, excluding the use necessary to carry out the test of its correct operation after manufacture.
5. The subject of the contract must be free from any physical and legal defects and claims by third parties.
6. The delivered item of the order must come from the distribution channel of the producer not excluding distribution to the Polish market and ensuring the fulfillment of warranty rights.
7. The subject of the contract must be delivered to the ordering party and all other activities described in the SWZ must be performed.
8. The subject of the contract must be delivered to the ordering party together with user manuals, controllers and accompanying software necessary for the proper use of the subject of the contract (obtaining full functionality indicated in Part IV of the Terms of Reference). With regard to the software supplied under this contract, the contracting authority may not be required to pay any additional fees, in particular licence fees, and the necessary licences will be granted as part of the contractor's remuneration, without any time or territorial limitation (applicable to the EU), unless otherwise expressly stated in Part IV of the Terms of Reference. If licenses, codes, or other entitlements are required to run and use this software, they must be provided at no additional charge. Codes, licenses, and other entitlements must also be provided when necessary to run or configure hardware components.
9. The supply item of the order intended for power supply from the power grid must be equipped with an appropriate number of power cables allowing it to be connected to standard power outlets unless otherwise stated in Part IV SWZ.
10. The subject matter of the contract offered on the day the tender is made may not be intended by the manufacturer to be withdrawn from production or sold.
11. The scope of the subject matter of the contract also includes the preparation of documentation, in accordance with the requirements set out in Part IV of the Terms of Reference.
12. The Contractor and all persons performing the subject of the contract are obliged to comply with the order regulations in force at the contracting authority's premises. Failure to comply with the above will result in the necessity to leave the contractor and all persons performing the subject of the contract from the contracting authority's facility.
Part 11.
