1. The subject of the contract is the performance of services related to the arrangement, purchase of plants and maintenance of low and high greenery and ongoing maintenance of order in the parks in the Targówek District of the Capital City Warsaw.

2. The detailed scope of services which are the subject of the contract are defined by:

1) a list of services constituting Annex 4a and 4b to the ToR,

2) description of the technology of providing services, constituting Annex 5a and 5b to the ToR,

3) list of parks, constituting Annex 7 to the ToR.

1. The subject of the contract is the performance of services related to the arrangement, purchase of plants and maintenance of low and high greenery and ongoing maintenance of order in the parks in the Targówek District of the Capital City Warsaw.

2. Social clauses:

1) The contracting authority in this procedure applies a social clause based on art. 29 paragraph 3a of the Act. The Employer requires employment by the Contractor or Subcontractor on the basis of an employment contract within the meaning of the Act of 26.6.1974 - Labor Code (Journal of Laws of 2019, item 1040) of persons performing the activities specified in the list of services, constituting Annex 4a and 4b to the ToR, necessary for the performance of the contract during the implementation of the subject of the contract.

2) The above condition will be met by employing new employees under the employment contract or appointing employees already employed by the Contractor or Subcontractor.

3. The Employer envisages providing the current Contractor with services, within 3 years of the award of the basic contract, the contract referred to in art. 67 section 1 item 6 of the Act, consisting in the repetition of similar services.

4. The value of the contract consisting in the repetition of similar services, in relation to the value of the basic contract, was set at 30%. The contract will be awarded provided that the Employer will have financial resources under the project described in the provisions of the ToR and in § 1 para. 1 and 2 of the model contract. The contract will be awarded under the terms of the basic contract. The contracting authority provides that the unit prices of services indicated in the valuation of services may be higher up to a maximum of 20% of the unit prices of the basic order.

15. The order consisting in the repetition of similar services will cover the scope given in Annex 4a and 4b to the ToR.
