1. The subject of the contract is the provision of the service of collecting municipal waste from owners of residential real estate located in the City of Kraśnik and their development and equipping owners of residential real estate with waste collection devices (containers, bags) no later than 7 days before the first planned date of waste collection, resulting from the collection schedule. Establishment by 31.01.2024 at the latest and maintenance and operation of 2 selective municipal waste collection points in the city of Kraśnik along with the management of collected municipal waste and removal of up to 120 Mg of waste from the cleaning up of wild landfills located in the city of Kraśnik.
2. A detailed description of the subject of the contract is attached as Annex 8 to the SWZ.

The subject of the contract is the provision of the service of collecting municipal waste from owners of residential real estate located in the City of Kraśnik and their development and equipping owners of residential real estate with waste collection devices (containers, bags) no later than 7 days before the first planned date of waste collection, resulting from the collection schedule. Establishment by 31.01.2024 at the latest and maintenance and operation of 2 selective municipal waste collection points in the city of Kraśnik along with the management of collected municipal waste and removal of up to 120 Mg of waste from the cleaning up of wild landfills located in the city of Kraśnik.
2. A detailed description of the subject of the contract is attached as Annex 8 to the SWZ.
3. The contracting authority, in accordance with Article 95 of the PPL, shall specify the following requirements for the contractor or subcontractor to employ persons performing the activities indicated by the contracting authority in the scope of contract performance:
1) The Contracting Authority shall require that throughout the entire period of performance of the contract, persons performing work on the performance of the subject of the contract (physical work) be employed by the Contractor or, as appropriate, by a subcontractor on the basis of an employment contract, if the activities performed by them consist in performing work within the meaning of Article 22 § 1 of the Act of 26 June 1974 - Labour Code (consolidated text: Journal of Laws of 2020, item 1320, as amended). The Ordering Party leaves the determination of employment conditions to the Contractor, with the proviso that the Contracting Authority requires that every person taking an active part in the implementation of the subject of the contract be employed under the above conditions.
2) Each time, at the request of the Contracting entity, within the time limit indicated by the Contracting entity, not shorter than 3 working days, the Contractor undertakes to submit to the Contracting entity:
a) a current statement that the persons referred to in paragraph 3 are employed by the Contractor on the basis of an employment contract, signed by a person authorized to represent the Contractor or a person/s authorized by the Contractor. The Contractor submits this statement under pain of liability for making false statements. On the terms set out in this paragraph, the Contractor shall submit to the Contracting Authority a statement concerning subcontractors. This statement should contain in particular: precise identification of the entity submitting the declaration, date of submission of the declaration, indication that the activities covered by the summons are performed by persons employed under an employment contract together with an indication of the number of these persons, type of employment contract with an indication of the number of these persons, type of employment contract and working hours, signature of the person authorized to submit the statement on behalf of the Contractor or subcontractor,
b) a certificate of the competent ZUS branch, confirming the payment by the Contractor or subcontractor of social and health insurance contributions for employment under an employment contract for the settlement period.
4. Whenever the Contracting Authority describes the subject of the contract by reference to standards, national technical assessments, European technical assessments, technical specifications, technical reference systems, it shall allow solutions equivalent to those described.
