2. The Contracting Authority provides for the exercise of the right of option referred to in Article 441(1) of the Public Procurement Law. The right of option is a right of the Ordering Party, which may or may not be exercised as part of the performance of this contract. If the contracting authority does not exercise the right of option, the Contractor shall not be entitled to any claims in this respect. The condition for activating the right of option is the Declaration of Will of the Ordering Party on the request for performance of the contract qualified by the Ordering Party as the right of option. The contracting authority shall exercise the right of option in the event of the need to secure additional needs of military units participating in field training while ensuring by the holder of a higher degree adequate financial resources for the implementation of such a contract.
