1. The subject of the contract is the construction of water and sewage infrastructure, installation of photovoltaic panels and purchase of a rescue and firefighting vehicle in the Łękawica Commune.
2. The order was divided into nine lots.
Construction of sanitary sewage system in Łękawica – Klonowa Street in Łękawica and in Okrajnik – Strażacka StreetPart of the contract No. 1 – "Construction of the sanitary sewage system in Łękawica – Klonowa Street in Łękawica and in Okrajnik – Strażacka Street"
1. As part of the contract No. 1 – the Contractor will be obliged to perform construction works consisting in the construction of a sanitary sewage system in Łękawica – Klonowa Street in Łękawica and in Okrajnik – Strażacka Street – in the design and build system, to the extent resulting from Annex 8a to the SWZ – Description of the subject of the contract for part of the contract No. 1, including the Functional and Utility Program together with attachments.
2. Equivalence clause:
(1) The contracting authority, in accordance with the provisions of Article 99(5) and Article 101(4) of the PPL, shall allow equivalent solutions for works, supplies, works, materials and systems meeting the requirements set out in the procurement documents. The Ordering Party reserves that wherever in the content of the SWZ or Annex 8a – 8e to the SWZ – Description of the subject of the contract for parts of the contract No. 1 – 5, constituting the description of the subject of the contract for these parts, trademarks, patents or the origin of equipment or materials have been indicated in the description of this subject, they should be treated only as proposals. The Ordering Party allows methods, materials, devices, systems, technologies, etc. equivalent to those presented in the description of the subject of the contract. Therefore, it is allowed to propose in the offer any equivalent market equivalents with properties not worse than those indicated by the Ordering Party. The parameters indicated in the procurement documents define the minimum technical, operational, utility, quality and functional conditions to be met by the subject of the contract. The offer may include methods, materials, devices, systems, technologies, but with technical, quality and functional parameters. At the request of the Contracting Authority, the Contractor is obliged to prove that the applied solutions will allow to achieve all technical assumptions for the investment task in question, taking into account the entire investment, and not a selected fragment of the whole. The burden of proving that the material or equipment is equivalent to the requirement specified by the Contracting entity shall lie with the Contractor. If the materials and/or equipment offered by the Contractor as equivalent are not equivalent in the light of the documents submitted by the Contractor, the offer of this Contractor will be rejected as not corresponding to the content of the SWZ. In the case of describing the subject of the contract by reference to standards, European technical assessments, approvals, technical specifications and technical reference systems, the Contracting Authority allows the performance of the contract using solutions equivalent to those described. In such a case, the procedure described in the earlier content of this paragraph shall apply mutatis mutandis;
2) in the case of equivalent technologies, systems, materials or devices adopted by the Contractor for valuation, the offer must be accompanied by a list of these technologies, systems, devices or materials, which will contain in its content the following: type and description of the technology or system used, name of the device/material used, name of the manufacturer, precise and unambiguous type of device or material.
3. The Contracting Authority requires that persons performing activities: construction works falling within the scope of the subject of the contract, i.e. manual workers performing activities consisting in performing work in the manner specified in Article 22 § 1 of the Act of 26 June 1974 – Labour Code (i.e. Journal of Laws of 2022, item 1510, as amended) – with the exception of persons performing independent technical functions in construction, Compliance with Article 12 et seq. Construction Law, were employed by the Contractor on the basis of an employment relationship.

These documents must clearly state the equivalence of the proposed technologies/systems/equipment/materials;
4) in case of doubts as to the equivalence of substitutes for equivalent technologies/systems/devices/materials proposed in the offer, the Ordering Party may require proving (documenting) equivalence at the stage of examination of the offer. In particular, for this purpose, it may request that the Contractor present the catalogues of the manufacturer of a given technology/systems/devices/equivalent materials.
