Collection and management of municipal waste from real estate located in Sector XII of the Association of Municipalities of the Płock Region - in the scope of the commune and city of Wyszogród

The subject of the contract is "Collection and management of municipal waste from real estate located in Sector XII of the Association of Municipalities of the Płock Region - in the scope of the commune and city of Wyszogród". A detailed description of the subject of the contract is set out in section II to the ToR. Employer in accordance with art. 29 paragraph 3a of the PPL Act requires employment by a contractor or subcontractor, on the basis of an employment contract, of persons performing the contract performance activities indicated by the contracting authority, if the performance of these activities involves the performance of work in the manner specified in art. 22 § 1 of the Act of 26.6.1974 - Labor Code (i.e. Journal of Laws of 2018, item 917, as amended). The scope of work of persons performing the activities indicated by the contracting authority in the implementation of this contract and the method of documenting the employment of these persons and the contracting authority's powers in the scope of controlling the contractor's compliance with the requirements and sanctions for non-compliance are specified in the model contract.

The subject of the contract is "Collection and management of municipal waste from real estate located in Sector XII of the Association of Municipalities of the Płock Region - in the scope of the commune and city of Wyszogród". The scope of the subject of the contract, including the contractor's obligations, are described in detail in the ToR in Section II to the ToR (OPZ) and the draft contract, which is an attachment to the ToR. The applicable form of remuneration is a lump sum remuneration for the entire duration of the contract from the date of signing the contract to 31/12/2019 - determined as a result of the selection of the contractor's offer submitted in the tender procedure. The contract's settlement period is 1 calendar month. The contractor undertakes to perform the contract with the help of persons employed under a contract of employment in the following areas: collection, transport and transfer for further management of municipal waste - vehicle drivers and loaders performing the service. Supervision over the service and implementation of the contract signed as a result of the award of the public contract - contract coordinator. In the event of the expiration or termination of the employment relationship with the employee referred to above, the contractor undertakes within 30 days of termination of employment to employment under a contract of employment in his place another person who will continue to perform the contract. The Contractor shall provide the contracting authority within 14 days from the date of signing the contract a statement of concluded employment contracts containing a list of employment contracts of all persons referred to in paragraph 1 above. The statement should include the type of employment contract, and in the case of fixed-term contracts - the duration of the contract, the dates of the employment contract, time, position and information on what activities under the contract will be performed by the employee, unless it results directly from the name of his position work. According to the previous sentence, the statement provided by the contractor will prevent the identification of the employee's personal data in accordance with applicable law. In the event of any change in the employment status of an employee, the contractor will provide the contracting authority with relevant information within 30 days from the date of the change. The contracting authority has the right to check compliance by the contractor with the obligation referred to in paragraph 1 above. As part of the audit, the contracting authority may, in particular, require the contractor to submit documents constituting proof of employment and set an appropriate time limit for this purpose, not shorter than 7 days. The proof of employment is in particular anonymous (making it impossible to identify the employee's personal data in accordance with applicable law), copies of current employment contracts or the employee's social security application. The contracting authority does not provide for the possibility of awarding a supplementary contract. The contracting authority requires a deposit. Before signing the contract, the contracting authority requires the contractor to provide a security on due performance of the contract.
