The subject of this contract is the purchase of electricity for the Employer's facilities and local government units of the Jędrzejowski Poviat and other entities operating within the Electricity Purchasing Group indicated in Annex 1 to the ToR, in accordance with the provisions of the Energy Law of 10.4.1997. Jędrzejowski Poviat, Jędrzejów commune, Oksa commune, Imielno commune, Małogoszcz commune, State Fire Service in Jędrzejów, Nagłowice commune, Sobków commune, Wodzisław commune, Szczekociny commune, Moskorzew commune, Radków commune, and the units listed in 1 to the ToR will conclude separate contracts resulting from these proceedings for the award of a public contract in an open tender for the "Purchase of electricity for the Electricity Purchasing Group". Detailed information on the conclusion of contracts by individual municipalities / poviats and their organizational units is contained in Annexes 1 and 4.1 to the ToR.

Jędrzejowski Poviat, Jędrzejów commune, Oksa commune, Imielno commune, Małogoszcz commune, State Fire Service in Jędrzejów, Nagłowice commune, Sobków commune, Wodzisław commune, Szczekociny commune, Moskorzew commune, Radków commune, and the units listed in 1 to the ToR will conclude separate contracts resulting from these proceedings for the award of a public contract in an open tender for the "Purchase of electricity for the Electricity Purchasing Group". Detailed information on the conclusion of contracts by individual municipalities / poviats and their organizational units is contained in Annexes 1 and 4.1 to the ToR. The obligation of the selected Contractor will be to terminate the existing electricity sale and distribution services agreements (comprehensive agreements) and to represent the Ordering Party and its organizational units before the relevant Distribution System Operator in matters related to the conclusion of new distribution agreements. To perform the above actions, the Contractor will receive an appropriate power of attorney (attachment No. 4.1 to the Terms of Reference).

Order - purchase of electricity for the facilities listed in Annex 1 to the ToR:

1) Estimated electricity demand in the period from January 1, 2013 to December 31, 2020 is 10 662 596.00 kWh.

2) The estimated value of the contract in the period from 1.1.2020 to 31.12.2020 is PLN 3,945 160.52.

3) Performing activities resulting from the power of attorney, constituting Annex No. 1 to the draft contract (Annex No. 4.1 to the ToR), in particular the Employer obliges the Contractor to notify the indicated Distribution System Operator for the implementation of the electricity sale contract concluded with the Contractor, making declarations of will and determining, on behalf of the Employer, all necessary information regarding the termination of the current contract for the sale of electricity and provision of distribution services (comprehensive agreement), representing the Employer before the relevant Distribution System Operator in matters related to the conclusion of the contract for the provision of distribution services.

The Awarding Entity, acts on its own behalf and on the basis of a signed Agreement (Agreement available for inspection at the Principal's seat), on behalf of the Poviat Headquarters of the State Fire Service in Jędrzejów and the following communes as well as their organizational units, which are indicated in Annex No. 1 to the ToR:

4. the commune of Małogoszcz

5. Poviat Headquarters of the State Fire Service in Jędrzejów

6. the commune of Nagłowice

7. the commune of Sobków

8. Wodzisław commune

9. the commune of Szczekociny

10. Moskorzew commune

11. commune of Radków

12. Krasocin commune

The ordering party informs that the process of changing the seller takes place for most of the collection points once again. Contracts for collection points with the next change of vendor are valid until December 31, 2019. there is no need to terminate these contracts, for points with the first change of vendor, comprehensive contracts are concluded for an indefinite period, information on notice periods is provided in Annex 1 to the ToR . All points that undergo the procedure of switching the supplier once again have separate contracts for the sale and distribution of electricity. Contracts for the distribution of electricity are concluded for an indefinite period. Detailed information is included in Annex 1 to the ToR.
