1. The subject of the contract is the execution of construction works consisting in the expansion of poviat road No. 2116 L Gardzienice - Fajsławice.
2. The scope of works includes in particular:
1) demolition works,
2) earthworks
3) performance of road pavement works together with surface works,
4) finishing works,
5) maintenance of green areas,
6) works related to vertical and horizontal marking.
A detailed description of the subject of the contract is included in Annex 1 to the ToR.
3. To the extent that the Annexes to the ToR indicate their own names or other markings directly or indirectly indicating a specific manufacturer or in the scope of the obligation to provide specific certificates, the Employer informs that the names are given only by way of example and the Employer allows offering equivalent solutions
1. The subject of the contract is the execution of construction works consisting in the extension of poviat road No. 2116 L Gardzienice - Fajsławice,
2. The scope of works includes, in particular, works as per item 3. A detailed description of the subject of the contract is included in Annex 1 to the ToR.
3. Employer, pursuant to art. 29 paragraph 3a of the Act, requires employment by the Contractor or subcontractor under an employment contract, persons performing the following activities falling within the scope of the contract:
1) demolition works,
2) earthworks
3) performance of road pavement works together with surface works,
4) finishing works,
5) maintenance of green areas,
6) works related to vertical and horizontal marking.
The Employer shall be entitled to control the compliance by the Contractor with the requirements regarding the employment of the persons referred to above.
The Employer reserves the right to carry out inspections at the place of performance of the subject of the contract in order to verify whether the persons performing activities during the performance of the contract are persons employed by the Contractor (subcontractor / further subcontractor). The Employer reserves the right to notify - for inspection - the National Labor Inspectorate.
In addition, during the performance of the contract, at the request of the Employer, the Contractor will be required to document within 5 working days the fact of employing persons implementing the object of the contract under the employment contract by submitting to the Employer the following evidence:
- statements of the Contractor or subcontractor / further subcontractor about employment on the basis of an employment contract of persons performing activities to which the Employer calls. This statement should include, in particular: an exact description of the activities performed by persons employed under a contract of employment and a full-time job, as well as the signature of the person authorized to make the statement on behalf of the contractor or subcontractor / further subcontractor,
- a copy of the proof confirming the employer's registration for insurance with a certified copy of the original, as appropriate by the contractor or subcontractor,
- a copy of the contract / employment contracts of persons performing during the performance of the contract activities certified by the contractor or subcontractor / subsequent subcontractor, respectively statement of the contractor or subcontractor / further subcontractor (together with the document regulating the scope of duties, if drawn up). A copy of the contract (s) should be anonymized in a manner ensuring protection of employees' personal data, in accordance with the provisions of the Act of August 29, 1997 on the protection of personal data, i.e. in particular without names, surnames, addresses, PESEL number of employees. The above calculation is exemplary. The employment contract may also contain other data that is subject to anonymization. Each contract should be reviewed by the applicant in terms of the provisions of the Act of August 29, 1997 on the protection of personal data; the scope of contract anonymization must be in accordance with the provisions of the above Act. Information such as: date of the contract, type of employment contract and full-time employment should be identifiable,
- a certificate from the competent ZUS branch confirming the payment by the contractor or subcontractor of social security and health insurance contributions due to employment on the basis of employment contracts for the settlement period indicated by the Employer.
4 The Purchaser reserves that wherever in the content of the ToR, in particular the design documentation and technical specifications for the performance and acceptance of construction works, which is a description of the subject of the contract, the trademarks, patents or origin, sources or detailed processes that characterize the products or services have been indicated supplied by a specific Contractor - the Employer allows methods, materials, devices, systems, technologies, etc. equivalent to those described in the description of the subject of the contract
