1. The subject of the contract is: "Supply of butterfly valves for welding"
2. Detailed data on the subject of the contract and its scope are specified in Appendices No. 1 and No. 2 to the Terms of Reference.
3. The equipment which is the subject of the order must be brand new, unused, i.e. manufactured no earlier than 6 months before the date of their delivery to the Ordering Party and meet the requirements set out in Appendix 2 to the Terms of Reference.
4. The Contracting Authority requires the Contractor to offer equipment from one manufacturer for the entire assortment.
5. The equipment which is the subject of the contract must:
- Be CE marked in accordance with applicable standards and regulations in this area.
- Have a declaration of conformity or a copy of the declaration of performance in accordance with
with applicable standards and regulations in this regard.
- Have an EC Certificate of Conformity (Declaration of Conformity) with Directive 2014/68/EU
on the essential requirements for pressure equipment and pressure plants.
- Meet the requirements provided for in the Act of 16 April 2004 on construction products (consolidated text Journal of Laws of 2021, item 1213) together with the implementing regulations to this Act,
- Meet the requirements provided for in the Act of 30 August 2002 on the conformity assessment system (i.e. Journal of Laws of 2023, item 215),
- Meet the requirements provided for in the Regulation of the European Parliament and of the Council (EU)
No 305/2011 of 9 March 2011 laying down harmonised conditions for the marketing of construction products and repealing Council Directive 89/106/EEC.
- Meet the requirements provided for in the Regulation of the Minister of Development of 11 July 2016 on the requirements for pressure equipment and pressure equipment sets (Journal of Laws of 2019, item 211) implementing Directive 2014/68/EU into Polish law.
- Meet the requirements of the EU environmental standards set out in
in the announcements of the President of the Polish Committee for Standardization on the list of harmonized standards.
- Have a PN-EN ISO 9001:2008 or newer Certificate concerning the subject of the contract, which the Contractor should obtain from the manufacturer from whom the dampers will be delivered.
6. The required minimum period of quality guarantee for the completed subject of the order: 36 months from the date of their protocol acceptance.
Warranty in accordance with the conditions set out in Chapters XVII and XX of the SWZ. Warranty period of 36 months is required.
7. Other terms and conditions of the Contracting Authority concerning the subject matter of the contract are set out in Chapter XIX of this Terms of Reference entitled "PROVISIONS OF THE PUBLIC PROCUREMENT AGREEMENT RELEVANT TO THE PARTIES".
