Delivery of portable computers for Faculties and inter-faculty units of the University of Wrocław as part of the public procurement procedure conducted in order to conclude a framework agreement

1.Order type: delivery.

2. The subject of the contract is the supply of portable computers for the Faculties and inter-faculty units of the University of Wrocław as part of the public procurement procedure conducted in order to conclude a framework agreement.

3. The subject of the contract includes Notebook I, Notebook II and Notebook III portable computers in the configuration indicated in the detailed description of the contract included in Appendix 3 to the Terms of Reference – Description of the subject of the contract/Minimum requirements.

4. The detailed scope of obligations to perform the subject matter of the contract can be found in the template of the framework agreement, constituting Appendix No. 4 to the Terms of Reference and the Implementation Agreement with attachments (invitation to submit an implementation offer, Implementation Offer Form, quantitative and qualitative acceptance protocol) constituting Appendix No. 4a to the Terms of Reference.

2. The subject of the contract is the supply of portable computers for the Faculties and inter-faculty units of the University of Wrocław as part of the public procurement procedure conducted in order to conclude a framework agreement. A "portable computer" is an electronic device consisting of components such as a processor, motherboard, memory, graphics card, expansion cards, storage (hard drive), battery, camera, microphone, integrated keyboard, pointing device, and display. The subject of the contract includes Notebook I, Notebook II and Notebook III portable computers in the configuration indicated in the detailed description of the order included in Appendix 3 to the Terms of Reference – Description of the subject of the contract/Minimum requirements.

The detailed scope of obligations to perform the subject matter of the contract can be found in the template of the framework agreement, constituting Appendix No. 4 to the Terms of Reference, and the Implementation Agreement with attachments (invitation to submit an implementation offer, Implementation Offer Form, quantitative and qualitative acceptance protocol) constituting Appendix No. 4a to the Terms of Reference.

3. The offer must be unambiguous and comprehensive, i.e. it must include the assortment of the subject of the contract. The offered subject of the contract must meet the requirements of the Ordering Party. The content of the Offer must be in accordance with the requirements of the Contracting Authority specified in the procurement documents.

4. The subject of the order must be brand new, unused, undamaged, non-displayed, free from physical and legal defects, it cannot be subject to the rights of third parties. The subject of the order must meet all applicable legal standards for the safety of Polish and EU regulations, have all legally required approvals and attestations as well as markings in accordance with the applicable regulations and be delivered in protective packaging.

5. The Contracting Authority informs that contracts executed under the framework agreement may be financed from the budget funds, in particular funds from the European Union. Details in this respect will be provided by the Contracting Authority at the stage of implementation of the Implementation Agreements.

6. The public procurement procedure shall be conducted in order to conclude a framework agreement with a maximum of 3 Contractors. In the event of submission of a maximum of 3 or fewer offers that are not subject to rejection, the Contracting Authority shall conclude a framework agreement with all Contractors who have submitted offers that are not subject to rejection.

7. In the case of concluding a framework agreement with at least two Contractors, the Contracting Authority shall award partial (implementation) contracts, the subject matter of which will be covered by the framework agreement, to these Contractors, inviting them to submit implementation offers.

8. In the case of concluding a framework agreement with one Contractor, the Contracting Authority shall award contracts to this Contractor on the terms and conditions specified in the framework agreement, without conducting a procurement procedure. Prior to concluding the framework agreement, pursuant to Article 313(2) of the Public Procurement Act. The Contracting Authority shall call on the Contractor in writing to complete the offer.

9.The implementation offer submitted as a result of the invitation may not be less favourable than the framework offer submitted in the present proceedings (i.e. the unit price for a given assortment may not be higher than in the initial offer submitted for the framework agreement). Thus, at the stage of execution of partial (implementation) orders based on a framework agreement, the offered (net) unit prices of equipment may not be higher than in the framework offer submitted in order to conclude a framework agreement.

10. Term of the framework agreement: 12 months from the date of conclusion of the agreement or until the amount specified in the framework agreement (the amount that the Contracting Authority intends to allocate to finance the contract) is exhausted, if this occurs before the expiry of the term for which the agreement was concluded – subject to the right of option referred to in Chapter II, point 19 of the Terms of Reference. The deadline for the completion of individual partial orders may not be longer than: 10 calendar days from the date of concluding the implementation agreement.
