The subject of this contract is: supply of electricity to facilities listed in Annex 1 to SWZ – description of the subject of the contract. The electricity demand in the period from 01.02.2023 to 31.12.2023 is: 3 504 404 kWh (maximum amount). Commercial balancing service for an energy consumption point (hereinafter also PPE) with a micro-installation installed – photovoltaic panels. Information about the microinstallation (capacity, amount of energy produced) is included in Annex 1 to the SWZ. The recipient is a producer of energy in a micro-installation. The energy will be used entirely for the Ordering Party's own needs. According to current data on the operation of micro-installations, there are no plans to return energy to the distribution network.

1.The subject of this contract is: 1.1 supply of electricity to facilities listed in Annex 1 to the SWZ – description of the subject of the contract. The electricity demand in the period from 01.02.2023 to 31.12.2023 is: 3 504 404 kWh (maximum amount). 1.2.us commercial balancing service for an energy consumption point (hereinafter also PPE) with a micro-installation installed – photovoltaic panels. Information about the microinstallation (capacity, amount of energy produced) is included in Annex 1 to the SWZ. The recipient is a producer of energy in a micro-installation. The energy will be used entirely for the Ordering Party's own needs. 2.The detailed scope of the contract is specified in Annex 1 to the SWZ, in accordance with the provisions of the Act of 10 April 1997. Energy law . Other conditions regarding the performance of the contract are specified in the draft provisions of the electricity sales agreement – Annex No. 2 to the SWZ. 3. The requirements (obligations) for the Contractor are described in the draft provisions of the sales agreement constituting Annex 2 to the SWZ. Performing activities resulting from the power of attorney constituting Annex 2 to the Electricity Sales Agreement, hereinafter referred to as the Agreement. 4.In the course of the contract, the Ordering Party reserves the right to reduce the total amount of purchased / returned electricity to the extent of up to 30%, in relation to the consumption/return of electricity indicated in point 1.1. (sale of energy) and point 1.2 (trade balancing service, also referred to as the POB service). 5.In terms of the amount of electricity specified in point 1 above, taking into account the entry in point 4 above, the Ordering Party may make: 5.1. reduce the amount of electricity resulting from the consumption / return of electricity according to current readings from the meter, which will be different from the amount of electricity indicated in paragraph 4.1. SWZ. The change takes place automatically, based on the current consumption / return of electricity on the invoices issued, 5.2. deduction of PPE, requires the submission of a unilateral declaration of will by the Ordering Party. A change in the amount of PPE may result in particular from the liquidation of PPE, the creation/acquisition of a new PPE, changes in the technical characteristics of PPE, double invoicing, in particular in the case of providing electricity sales services on a given PPE by another seller, changes in the legal or technical status of PPE, changes in the scope of the buyer, recipient, payer, in particular the transfer of rights and obligations related to the facility, at which the PPE data is located, the occurrence of legal and formal obstacles preventing the procedure of changing the seller or switching on the collection point by the Ordering Party. 6.The Ordering Party has the right, during the term of the agreement, to change tariff groups, contractual capacity for individual PPE specified in Annex 1 to the Agreement (Annex 1 to the SWZ) after prior agreement on the technical conditions for making these changes with the Distribution System Operator, hereinafter referred to as DSOs.
