Successive delivery of red meat with animal fats and red meat sausages to food service warehouses in Nowa Dęba, Kielce and Sandomierz (order divided into 6 parts)

Successive delivery of red meat with animal fats and red meat sausages to the warehouses of the 33rd Military Economic Branch in Nowa Dęba, Kielce and Sandomierz (order divided into 6 parts) 1) The subject of the contract is the successive delivery of red meat, animal fats and red meat sausages to the warehouses of the Food Service

in Nowa Dęba, Kielce and Sandomierz (order divided into 6 parts). A detailed description of the assortment constituting the subject of this procedure is included in the appendix to this Specification of the Terms of Contract – Description of the subject of the contract and the detailed valuation form. Detailed quantities of the assortment being the subject of this order are included in the attachment to this SWZ – Detailed valuation form. 5) Pursuant to Article 441 of the Public Procurement Law of 11 September 2019, the Contracting Authority provides for the possibility of exercising the option right.

5) Pursuant to Article 441 of the Public Procurement Law of 11 September 2019, the Contracting Authority provides for the possibility of exercising the option right. Detailed specification of the quantity of a particular assortment constituting the subject of this order in terms of the right of option is included in the attachment to this SWZ, i.e. the detailed valuation form.

6) The Ordering Party stipulates that deliveries covered by the option right must be made under the conditions specified for the basic contract. In accordance with the provisions of the draft contract, the Ordering Party requires that the value of the unit price of the individual assortment covered by the supply be the same in relation to the basic order and contracts awarded under the option right.

7) Within the framework of the right of option, the Ordering Party reserves the right to fully or only partially use the orders covered by the option right,

which will be specified in each case in the statement on the award of the contract submitted under the right of option.

8) Each time the condition for activating the option right is the declaration of will of the Contracting Authority to perform the contract under the option right with the definition of the scope

a contract awarded under a right of option.

9) The Ordering Party is entitled to make a declaration at its own choice

in the subject of the contract awarded under the right of option once or repeatedly according to the needs of the Ordering Party.

10) Regardless of the level at which the Contractors will be awarded contracts

under the option right, the Contractor will always be entitled only to remuneration for the deliveries made.

11) The draft agreement presented in the annex to this SWZ supplements the description of the subject of the contract in the scope of provisions not regulated by the provisions of this Chapter.

12) The production of the subject of the contract, the method of its packaging and transport must meet the requirements of the applicable national and EU provisions of food law. These provisions are specified in detail in the Annex to the SWZ – draft agreement.

13) Contractors as entities operating on the food market, running food trading or catering establishments are obliged to ensure food safety in accordance with the principles of the Hazard Analysis and Critical Control Points System, called the "HACCP system" (procedure aimed at ensuring food safety by identifying and assessing hazards from the point of view of food health requirements and the risk of hazards occurring during all stages of production and marketing food, this system also aims to identify methods to eliminate or reduce hazards and to determine corrective actions). In connection with the above, the Contractor applying for the award of the contract must have the following current documents (including for the duration of the contract), which it will present at the request of the Contracting Authority

i.e. confirmation of the implemented HACCP system in the form of a HACCP certificate issued by companies with accreditations and powers of the Polish Accreditation Centre

with its registered office in Warsaw or national accreditation organisation for the country concerned or a certificate from the competent authority of the State Sanitary Inspection or the body of the Veterinary Inspection on the supervision of the application of the implemented HACCP system confirming the fulfilment of the requirements necessary for to ensure hygiene in the production process or marketing of articles subject to contract and to ensure the proper quality of those articles.

The order will be executed in the period from 01.01.2024 - 31.12.2024
