The Brussels Urban Planning and Heritage Regional Public Service (hereinafter referred to as urban.brussels) is an administration of the Brussels-Capital Region.
Its main objective is to support the territorial development of the Region in a sustainable way, by implementing regional policy on urban planning, movable and immovable cultural heritage and the management of operational programmes for urban regeneration.
Urban.brussels carries out these missions through various operational departments, one of which is the Urban Renewal Department. One of the missions of Urban Renewal is to communicate to the pre-emptive authorities that a property is subject to sale, and therefore, that they can exercise their right of pre-emption according to criteria that are included in the Brussels Spatial Planning Code (COBAT). The Urban Renewal Directorate of the Brussels-Capital Region (RBC) acts as organiser of the enforcement of the right of pre-emption between a pre-emptive authority and the sellers, represented by notaries.
In this context, the contracting authority draws up these specifications to respond to two scenarios:
• Specific pre-emption: this applies to all properties within a perimeter defined by municipal decree;
• Generalized pre-emption: this applies to all properties with an area of 500 m² throughout the region.
Only specific preemption is currently applied; the generalized redemption will come into effect as early as Q1 2024. With the arrival of the second right of pre-emption, Urban Renewal must equip itself with a tool for managing pre-emption files that will make the link between notaries (input) and the pre-empting powers (output) of the RBC.
The objective of this CSC is to define the needs of the tool that will receive the data necessary for the processing of files from the FedNot platform, to be able to notify the pre-emptive powers that they can exercise their right, collect their answers and transmit them to notaries.
