The subject of the contract is the provision of services in the field of winter and summer cleaning of municipal roads, internal roads, sidewalks and parking spaces in the Paid Unguarded Parking Zone (SPPN), in the capital city of Warsaw, which are managed by the Wola District.
1) The detailed scope, conditions and manner of performance of the subject of the contract are specified in the draft provisions of the contract, hereinafter also referred to as the contract template, constituting Annex 6 to the SWZ together with:
a) Annex 3 – "list", which includes:
- list of municipal and internal roads,
- a list of sidewalks and parking spaces,
- a list of pedestrian crossings,
- a list of parking spaces for the disabled,
b) Appendix 4 – "Map of settlements",
and the model Price Form, constituting Annex 11 to the SWZ
2) The Contractor is obliged in the price calculation as part of winter road cleaning to take into account that the dose of road or rock salt during the snow removal action must depend on temperature (maximum dose is 25 g / m2), in accordance with Annex No. 1 to the Regulation of the Minister of the Environment of 27 October 2005 on the types and conditions of use of agents that can be used on public roads and streets and squares (Journal of Laws of 2005 No. 230, item 1960).
3) The contracting authority in the proceedings in question applies a social clause pursuant to Article 95 of the PPL. The contracting authority requires that persons performing the subject of the contract and performing activities related to the provision of services consisting in winter and summer cleaning of municipal roads, internal roads, sidewalks and parking spaces in the Paid Unguarded Parking Zone (SPPN) be employed by the Contractor or Subcontractor, on the basis of an employment relationship, In accordance with the Law of 26 June 1974. Labour Code (i.e. Journal of Laws of 2022, item 1510, as amended). Detailed requirements regarding the method of documenting and verifying the employment of these persons and the rights of the Contracting Authority in the scope of control of this employment and sanctions for failure to meet these requirements are included in the model contract, constituting Annex 6 to the SWZ.
4) Information on the division/non-division of the contract into lots.
The contracting authority divided the contract related to street cleaning and snow removal services into lots, each of which is the subject of a separate procedure. The present proceedings concern one of the abovementioned parts of the contract.
5) Pursuant to § 5 clause 8 of the model contract, the Contractor is obliged to have a civil liability policy for the conducted activity for the sum insured not lower than PLN 1,000,000.00 (in words: one million PLN 00/100), throughout the duration of the contract.
6) The Contracting Authority informs that it intends to allocate a gross amount of PLN 3,047,655.96 to finance the awarded contract.
(7) The contracting authority does not provide for the possibility of awarding contracts pursuant to Article 214(1)(7) of the PPL.
8) Subcontractors: all information regarding subcontracting has been included by the Contracting Authority in the model contract constituting Annex 6 to the SWZ. The Contracting Authority requires that the Contractor in the statement - the Single European Procurement Document (ESPD) indicates to the Contracting Authority whether it will perform the contract on its own or whether it intends to entrust the Subcontractors with the performance of part of the contract.
9) In these proceedings, the Contracting Authority provides for the application of the procedure referred to in Article 139(1) of the PPL. Pursuant to the said provision, the Contracting Authority shall first examine and evaluate the bids, and then shall make the subjective qualification of the Contractor whose bid was rated the highest in terms of the lack of grounds for exclusion and meeting the conditions for participation in the procedure.
10) The Contracting Authority provides that the contract will be executed for a period of 12 months from the date of signing the contract, but not earlier than from 01.11.2023, but no longer than until the amount referred to in § 3 section 2 of the model contract is exhausted.
