1. The subject of the contract is: “Comprehensive sale of gas fuel to the Contracting Authority in 2022 “as indicated in Chapter I, point 1 — paragraph 4.
2. The subject of the order includes the comprehensive sale of high-methane natural gas with the symbol E with a total estimated volume of 14,577,144 kWh during the delivery period to the facilities listed in Annex 1 to SWZ.
3. Detailed description of the object of the order, among others, a list of collection points together with tariff groups, contractual powers and forecast quantities of gas fuel consumption, include the Specification of the Terms of Order and Annex No 1 to SWZ
1. The subject of the contract is: “Comprehensive sale of gas fuel to the Contracting Authority in 2022 “as indicated in Chapter I, point 1 — paragraph 4.
2. The subject of the order includes the comprehensive sale of high-methane natural gas with the symbol E with a total estimated volume of 14,577,144 kWh during the delivery period to the facilities listed in Annex 1 to SWZ.
3. A detailed description of the subject matter of the order, inter alia, a list of the collection points together with tariff groups, contractual powers and forecast quantities of gas fuel consumption, includes Annex No 1 to SWZ.
4. The Contractor shall make all the actions and arrangements with the DSO necessary to carry out the change of the seller and the effective start of the sale of gaseous fuel, including in particular: the notification to the DSO of new comprehensive gas fuel sales contracts. These actions shall be performed by the Contractor on the basis of the relevant powers of attorney granted by each of the Contracting Authority listed in point 1 of the SIWZ, together with the conclusion of comprehensive contracts for the sale of gaseous fuel.
5. Gas fuel supplied must meet technical standards in accordance with the provisions of the Energy Law Act, implementing acts and Polish Standards.
6. Due to the nature of the supply provided by the Contracting Authority, the anticipated consumption of gas fuel is of an estimate in nature and has only an indicative value to compare, calculate the value of the offer and does not constitute an obligation to purchase gas in the quantity given. The Contractor shall not be entitled to any claim for the purchase by the Contracting Authority (gas customers) of less or more natural gas, other than the need to pay for the actual amount of gas collected and the transmission service in accordance with the applicable tariff.
7. The rates of distribution fees indicated in Annex 2 (Offer Form) are derived from the current tariff of the local DSO and may change during the execution of the order if the tariff of the local DSO changes. For the purposes of carrying out this procedure and comparing tenders, Contractors shall accept the indicated rate values for the entire period of execution of the contract in the calculation of the tender
8. The sale of gas fuel will be carried out on the basis of contracts concluded separately by the individual organisational units of the Contracting Authority, as detailed in Annex No 1 to the SIWZ.
9. Implementation of the object of the contract will be carried out in accordance with the provisions of the Energy Law Act and implementing acts issued pursuant to it.
10. The Contracting Authority authorises the conclusion of contracts by correspondence.
