1. The order includes:
1) Setting up a new signage
2) Rearrangement of existing markings
3) Dismantling of existing markings
4. Location of delivery of signs, marking elements, road safety devices with installation: Provincial road No. 853 Majdan Nowy – Tomaszów Lubelski from km 0+000 to km 51+533, in accordance with the bill of quantities and the project of permanent traffic organization on the provincial road No. 853.
5. The order should be executed in accordance with the bill of quantities and the description of the subject of the contract constituting an attachment to the SWZ, where the delivery of signs, marking elements and road safety devices together with the installation has been described in detail.
6. The Contractor shall deliver all elements together with the delivery and hand over to the person exercising supervision (on the part of the Contracting Entity):
(a) Warranty of the product,
(b) A technical approval or a national technical assessment issued by an approved body together with a declaration of performance.
The transfer of the above documents to the person responsible for the execution of the order on the part of the Contracting entity shall constitute the basis for accepting the invoice issued by the Contractor.
7. If the durability of the built-in components is found to have been lost during the manufacturer's warranty period. The Contractor shall, at his own expense, replace defective elements with elements free from defects.
8. Transport of materials and ready-to-assemble materials (handles, bolts, nuts, etc.) should be carried out by means of transport in a way that prevents them from moving during transport and damage. Road safety devices must be properly secured during the transport period so that they do not move and reach the place of installation undamaged.
9. Unit prices include: the price of individual types of signs with handles and screws, preparatory works, marking works, embedding, setting up and assembly, loading and unloading and removal of the material from dismantling to the warehouse of the Ordering Party in the Road Circuit in Józefów, Batalionów Chłopskich 29, 23-460 Józefów, as well as cleaning works.
10. The Ordering Party reserves the right to reduce the number of pieces of individual assortments of materials in relation to those specified in the price form.
11. The Contractor is obliged to ensure safe traffic and pedestrian conditions in the area of the installations covered by the contract on the basis of a temporary traffic organization project provided by the Contracting Authority (for the duration of the installations) and approved by the Traffic Manager.
12. The Contractor shall secure the marking of works during their conduct on their own.
13. The Contractor shall provide all necessary materials, means of transport and persons necessary to perform the contract.
14. Materials questioned in terms of quality will be left at the disposal of the Contractor. The Contractor undertakes to remove the defective material from the place of assembly at its own expense and provide materials free from defects within 7 days from the date of notification by the Ordering Party.
15. Delay in handing over the road lane, for reasons attributable to the Contractor, may not be the basis for changing the deadline for performance, resulting from the submitted instruction.
16. Cleaning the road lane at the installation site will be carried out by the Contractor on an ongoing basis.
17. The contract has not been divided into smaller lots, which does not affect the proper performance of the contract. The division into smaller deliveries makes it even impossible to coordinate the proper securing and maintenance of road markings.
20. As part of the contractual remuneration, the Contractor is obliged to "- ensure the participation of electric vehicles or vehicles powered by natural gas in the fleet of vehicles used in the performance of the public task in question, in the share specified in Article 68 paragraph 3 of the Act of 11 January 2018 on electromobility and alternative fuels (Journal of Laws of 2021, item 110, as amended). as amended), having regard to Article 36a, which lays down rules for rounding percentages when calculating the number of vehicles required, where the performance of a public task requires the disposal of motor vehicles. The specific number of vehicles will be indicated by the Contractor at the stage of signing the contract."
