In the event that the scope of network equipment referred to in Annex 8 to the Act on tax on goods and services of 11 March 2004 (i.e. Journal of Laws of 2022, item 931, as amended). The contracting authority reserves the right to apply a VAT rate of 0% in accordance with Article 83(1)(26)(a) of the same Act, subject to the consent of the Minister of Science and Higher Education. The Contracting Authority shall provide the Contractor with information on obtaining the consent issued by the Minister of Science and Higher Education, on the basis of which the Contractor will be obliged to issue an invoice with the applicable VAT rate.

In the scope of the subject of the contract, sales and delivery are required along with bringing the subject of the contract to the place indicated by the Ordering Party.

The offered equipment must be brand new, coming from the official distribution channel of the manufacturer and registered in the Ordering Party's systems in the manufacturer's systems, manufactured not earlier than 12 months before delivery to the Ordering Party.

The delivered subject of the order must be free from physical and legal defects.
