A detailed description and scope of the contract are contained in Annexes 6 (model contract) and 7 (opz) to the tender specifications, which are an integral part of it. 2. The Ordering Party shall not allow the submission of partial tenders. Only tenders covering the entire contract will be taken into account. The Contracting Authority does not allow the possibility of submitting variant offers. The Contracting Authority does not allow the possibility of submitting partial tenders. The order is indivisible into parts, because for technical reasons it forms an inseparable whole. The subject of the contract was described by multi-discipline design documentation, providing for the implementation of works, including basic and auxiliary processes that make up the entire construction process, as a result of which a functionally and technically consistent effect will be created in the form of the construction of the building of the District Court and the District Prosecutor's Office in Wieliczka. In addition, the construction work described in the design documentation is a set of technologically interrelated production processes carried out on the construction site, the ultimate goal of which is to create a coherent internal structure of the structure and give a uniform form that together meets the required functional properties. A possible division of the basic processes into parts would make it impossible to carry out works using the uniform work method, which assumes the performance of tasks of equal size without accumulations and interruptions, with the involvement of a strictly defined fixed number of workers, a fixed number of machines, transport units, the demand for materials and other resources and factors of production necessary for the planned duration of the works. Each work process provided for the implementation of the subject of the contract is a separate working plot, necessary for the implementation of works method of even work. Dividing the order into parts would entail an increase in costs for the duration of the construction. Such an exaggerated action would expose the contracting authority to spending public funds in a manner inconsistent with the Public Finance Act, i.e. in an inexpedient and inefficient manner, with the lack of compliance with the principles of obtaining the best results from given expenditures and optimal selection of methods and means to achieve the assumed goals. It is also unjustified to award a contract for parts for technological, quality and warranty reasons.
