Natural gas for a consumption point of the Langenhagen Water World, owned by the city of Langenhagen in Lower Saxony

A total of 1 point of consumption with a reference consumption of 5,296,744 kWh/a

Delivery period from 01.01.2024, 6.00 a.m. to 01.01.2026, 6.00 a.m.

The bidder submits a service price for RLM separately for 2024 and 2025. This will be evaluated.

The energy pricing RLM takes place according to spot market EEX Gas Price Reference EGIX (Germany) (THE Month) .

At RLM, no tolerance band is agreed.

Due to the judgments of the ECJ (ECJ, judgment of 19.12.2018 – C-216/17 – "Antitrust and Coopservice") and ECJ, Urt. v. 17.06.2021 – Case C-23/20), according to which a framework agreement is to lose its effect when the maximum limit is reached (see also OLG Koblenz, decision of 12.12.2022 – Verg 3/22), the following stipulation is made (which makes no sense in energy tenders, but is required by some RPAs):

The maximum amount of energy that can be purchased p.a. per lot is 200% of the amount of energy specified as the reference quantity per lot (reference quantity) p.a.

The contract shall be awarded to the most economical tender meeting the terms of the invitation to tender. The sole award criterion is the lowest price.

The evaluation of the present procurement model is based on the specifications of number 10 of the service description.

If no economic offer is received, the invitation to tender will be cancelled. Costs for processing the offers will not be refunded.
