Conclusion of discount contracts in accordance with Section 130a (8) SGB V for pharmaceuticals in the generic market

The subject of the tender is the conclusion of discount agreements pursuant to § 130a Abs. 8 SGB V for the period from 01.02.2024 to 31.01.2026 (AOK XXVIII). The invitation to tender is based on the active ingredient for 109 specialist lots. In principle, each active ingredient represents its own specialist lot, unless special features are named separately. For each subject lot, eight partial lots (territorial lots) shall be formed in accordance with the detailed provisions in the tender documents. The bidders themselves decide for which lot(s) and which area(s) they want to submit discount offers. Tenders can be submitted for one, for several or all subject and area lots. The contract is awarded per subject and area lot. Depending on the subject lot and territorial lot combination, discount agreements shall be concluded with one or - provided that there are sufficient tenders capable of being awarded - with up to three pharmaceutical companies, depending on the subject lot and territorial lot combination.

A contractually agreed maximum quantity applies for each unrelated and regionless combination, after which the contract period ends regardless of the 24-month contract period in principle.
