According to § 291a SGB V, gematik has the legal mandate for the introduction and further development of the telematics infrastructure ("TI") in the healthcare sector. For this, gematik regularly requires the support of external staff. The external forces should be made available by way of temporary employment in accordance with the Temporary Employment Act (AÜG). For the areas mentioned in the terms of reference, gematik intends to conclude a framework contract for temporary employment with as many as possible, at least all interested contractors (lenders) until any exclusive contracts come into force following a public tender. The framework agreement as part of the approval procedure will enter into force for the first time on 22 October 2018 and will end subject to the contractual extension option on 30 September 2018. Irrespective of this, it automatically ends with the entry into force of any exclusive contract resulting from a formal award procedure.

The subject of the procurement requirements are the following categories of services according to the terms of reference underlying this procedure:

- business analyst for eHealth applications,

- IHE Specialist,

- IT architect for distributed systems,

- Software Architect / Senior Developer for mobile platforms iOS and Android,

- Test Specialist,

- IT project manager,

- Specialist IT project management,

- Service Delivery Manager,

- Transition Manager.

The prospective buyer must make a commitment to at least one (1) of the above performance categories. In addition, the determination of several or all of the above-mentioned performance categories is fully possible.

Note: Publication is made here using the open procedure form. However, this is NOT such an open procedure - the Notice Form had to be used for technical reasons, as there is no form suitable for approval procedures. On the contrary, gematik assumes that this authorization procedure does not fall within the scope of the "antitrust law" due to the lack of a selection decision and thus the non-discriminatory access of all companies providing the contract to the framework contract.

In order to cope with the diversity of potential contractors within the framework of the authorization model, any suitable undertaking will be able to join the framework contract at any time and under the same conditions during the contract period. The contract documents required for this purpose are listed under I.3. mentioned link for download. Prerequisites for the admission, or later joining, of the framework contract, which enters into force on 22.10.2018, is the complete and timely submission of the following documents / declarations / attachments (available for download under the link under I.3.) To the following listed contact person at gematik:

1) Application for admission or accession to the framework contract "External Assistance 2 - Diverse Specialists (IT / PM)" - RXÜ 2 - DS (OH) (form);

2) Proof of entry in the professional or commercial register (not older than 6 months at the time of application for admission or accession) in accordance with the legislation of the country in which the company is established (in unconfirmed copy) or if Applicable, Declaration that there are no entries in the professional or commercial register according to the relevant national legislation (form);

3) Signed self-declaration of the company on reliability (form);

4) Signed self-declaration that the company has fulfilled its obligations to pay taxes, levies or social security contributions (form);

5) Proof of the existence of a permit for the provision of employees to third parties for work performance in accordance with § 1 para. 1 of the Law on the Regulation of Temporary Employment Assurance (AÜG).

6) Signed and stamped framework contract "External Assistance 2 - Diverse Specialists (IT / PM)" - RXÜ 2 - DS (OH) (3 times original) without attachments.

The above-mentioned documents must be marked by post with "Open-House Procedure Framework Contract External Assistance 2 - Various Specialists (IT / PM)" to be submitted to:

Gematik - Gesellschaft für Telematikanwendungen der Gesundheitskarte mbH, z. Hd. André Schmolke, Friedrichstr. 136, 10117 Berlin.

In order to join the Framework Contract on 22 October 2018, the previously named documents must be received by gematik at least seven (7) days in advance, ie no later than 15.10.2018, 24.00 hrs. Subsequent accessions generally take place seven days after receipt of the application for admission or joining the master agreement at gematik.
