The detailed scope of the contract is specified in the Appendices to this Terms of Reference, in particular the Description of the subject matter of the contract constituting Appendix No. 2 to the Terms of Reference, the cost estimate constituting Appendix No. 3 to the Terms of Reference and the draft agreement constituting Appendix No. 5 to the Terms of Reference.

4. The Contracting Authority did not divide the subject matter of the contract into lots due to financial aspects and ensuring the competitiveness of the tender. The contract was analysed in terms of costs and ensuring the competitiveness of the tender.
The review of the documentation clearly shows that the award of the contract as a whole is justified and will allow, among other things, to increase the competitiveness of the offer and interest on the part of future Contractors, which will increase the chance of winning the tender and obtaining better financial conditions. The purchase of a tractor with attachments as a whole order will allow you to purchase coordinated equipment, ready to work. In addition, awarding the contract to one Contractor will allow for efficient and fully coordinated provision of service for the equipment by the Contractor, in accordance with the requirements of the Contracting Authority.
5. Subcontracting provisions
5.1 The Contracting Authority does not reserve the obligation for the Contractor to personally perform key parts of the contract. The Contractor may entrust their execution to a Subcontractor.
5.2 The Contracting Authority requires the Contractor to indicate the part of the contract which it intends to entrust to the Subcontractor and to provide the companies of the Subcontractors, if such information is known to the Contractor.
5.3 If the Subcontractor is not indicated in the offer, the Contracting Authority shall assume that the Contractor has declared that the contract will be performed without the participation of Subcontractors, i.e. with its own resources.
6. Pursuant to Article 95(1) of the Public Procurement Law, the Contracting Authority requires the Contractor or subcontractor to employ persons performing activities related to the maintenance of the tractor with attachments on the basis of an employment contract. Detailed conditions related to this requirement are described in the model agreement.
7. The Contracting Authority shall not allow the submission of partial tenders.
8. The Awarding Entity does not allow the submission of variants.
9. The Contracting Authority does not provide for the possibility of awarding contracts referred to in Article 214 of the Public Procurement Law.
10. The Contracting Authority does not envisage concluding a framework agreement.
11. The Contracting Authority does not provide for an electronic auction.
12. The Contracting Authority does not provide for reimbursement of the costs of participation in the procedure.
13. The Contracting Authority does not provide for the granting of advance payments for the performance of the subject of the contract.
