1. The subject of this order is the supply of electricity to the facilities listed in Annex 1 to SWZ, description of the subject of the contract. The electricity demand for the period from 01.11.2021 to 31.12.2023 is: 13,241,641 kWh (planned order).

4.2. The detailed scope of the contract is set out in Annex 1 to the SWZ, in accordance with the provisions of the Act of 10 April 1997. Other conditions for the execution of the contract are set out in the draft contract for the sale of electricity — Annex 2 to the SWZ.
4.3. The supply of electricity will be carried out under the conditions laid down by the provisions of the Act of 10 April 1997 — Energy Law and in accordance with the implementing provisions issued thereto, in particular with the quality standards of customer service set out in the Regulation of the Minister Energy of 6 March 2019 on detailed rules for the formation and calculation of tariffs and clearing in electricity trading. The quality parameters of electricity in the distribution part are governed by the Regulation of the Minister of Economy of 4 May 2007 on the detailed conditions for the operation of the electricity system.
4.4. Distribution services will be provided under a separate contract concluded by the Contracting Authority with the relevant Distribution System Operator (referred to as the DSO) — the DSO data is contained in Annex 2 to the SWZ. Reserve sales are provided by: ENERGA-OBRÓT S.A.
4.5. The requirements (obligations) to the Contractor are described in the draft sales contract constituting Annex 2 to the SWZ. The performance of the activities arising from the power of attorney constituting Annex No 2 to the Agreement for the Sale of Electricity, hereinafter referred to as the Agreement. The Contracting Authority shall grant the Contractor a power of attorney as determined in the proceedings.
4.6. The existing electricity sales contracts with existing electricity sellers for the electricity collection points contained in Annex 1 SWZ are contained for a fixed and indefinite period, and the exact description for each of the PPE points can be found in the column called “Period the validity of the contract/ period of notice”.
4.7. Annex No 1 of SWZ informationally identifies the current parameters (tariff group/contractual powers) which may be subject to change during the course of the electricity contract.
4.8. In the course of implementation of the Agreement, the Contracting Authority reserves the right to reduce or increase the total amount of energy purchased in the range: increase to 20%, reduction to 30%, relative to the electricity consumption specified in paragraph 4.1 above. The existence of the circumstances referred to above shall, accordingly, reduce or increase the remuneration payable to the Contractor under this Agreement. Increasing or reducing the amount of electricity does not constitute a basis for any claims on the part of the Contractor. The scope and rules for amending the SWZ paragraphs 4.8.1 to 4.8.3.
4.9. The Contracting Authority shall, during the period of validity of the Agreement, modify the tariff groups, the contractual power for the individual PPE set out in Annex 1 to the Agreement after having agreed the technical conditions for such amendments with the Distribution System Operator, hereinafter referred to as the DSO. Amendments to the Agreement will be made by written notification of the Contracting Authority to the Contractor starting with the amendment by the DSO. These amendments will be carried out on the basis laid down in the tariff of the operator of the distribution system suitable for the Contracting Authority and will concern, in particular ensuring that the facility has a proper functioning (consistent with its intended purpose) and/or reducing costs on the service distribution.
