Delivery of specialized chemical products

The subject of the contract is the purchase and delivery of chemical products, divided into 32 parts.

The type and quantity, as well as quality requirements relating to at least the main elements of the ordered assortment include:

Price Form – Annex 3 to the SWZ and

Description of the Subject of the Order – Annex 5 to the SWZ.

Part 1 – SPECIALTY PAINTS A

The subject of the contract is the purchase and delivery of chemical products.

The type and quantity, as well as quality requirements relating to at least the main elements of the ordered assortment are included in the Price Form – Annex No. 3 to the SWZ and the Description of the Subject of the Order – Annex 5 to the SWZ.

The Ordering Party requires filling in the column: Offered NSN/PN manufacturer in order to identify the offered product in terms of compliance with the requested one. The Contractor is obliged to fill in the column in order to make an indisputable identification of the offered assortment, enabling the Ordering Party to familiarize itself with its technical parameters.

Failure to indicate the manufacturer - if applicable, NSN - if present and P/N in any of the items in the lot for which the tender is submitted will result in the rejection of the offer as inconsistent with the terms of the contract.

The subject of the order should be delivered in the original, unit packaging of the manufacturer.

The subject of the contract must have a shelf life of not less than 70 % of the full use-by time indicated by the manufacturer.

Together with the subject of the contract, the Contractor is obliged to provide information on its shelf life, if it does not result from the documents or packaging provided.

When delivering the subject of the contract, the Contractor is obliged to attach safety data sheets (MSDS) in Polish. Failure to provide a safety data sheet will result in refusal to accept the goods.

If the delivered goods (in part or in whole) do not correspond to the description specified in the procurement documents – – the Ordering Party will refuse to accept the goods, and the Contractor will be obliged to deliver the goods in accordance with the subject of the contract within the term of the contract at its own expense.

The Ordering Party requires that a representative of the Contractor be present at the delivery of products of all parts.

The Ordering Party provides for a one-off delivery for each part.

A manufacturer's warranty will apply to chemical products. The Contractor is obliged to provide the Ordering Party with guarantee documents of the delivered goods, if such were granted by the manufacturer. For goods for which the manufacturer does not specify the warranty period, the responsibility for the quality of the delivered goods shall be assumed by the Contractor for a period of 24 months from the date of delivery to the Ordering Party.

EQUIVALENT PRODUCTS

If the brand, manufacturer or generic name is indicated in the procurement documents, this should be treated as an exemplary product. The Contractor may offer a product equivalent to the one indicated by the Contracting Entity. Equivalent products must have technical parameters not worse than those specified in the price form - Annex 3 to the SWZ and in the OPZ - Annex 5 to the SWZ.

The use of equivalent materials must not breach the terms of the warranty or void the warranty

The Contracting Authority allows for the offer of equivalent products, but the burden of proving equivalence rests with the Contractor. Therefore, the Contractor who offers equivalent solutions must unquestionably demonstrate in the offer that they meet the requirements specified by the Contracting Authority (equivalence criteria indicated in the Description of the subject of the contract - Annex 5 to the SWZ).

The Contractor offering an equivalent product is obliged to provide in the Price Form – Annex 3 to the SWZ (in the column "Offered manufacturer NSN / PN") the exact name and description of the equivalent product (including the name of the manufacturer - if applicable, NSN - if there is also P/N), on the basis of which the Ordering Party will be able to unquestionably identify the offered assortment and get acquainted with its technical parameters.

Equivalent products must have technical parameters not worse than those specified in the price form - Annex 3 to the SWZ and in the OPZ - Annex 5 to the SWZ.

The use of equivalent materials must not breach the terms of the warranty or void the warranty

The Contracting Authority allows for the offer of equivalent products, but the burden of proving equivalence rests with the Contractor. Therefore, the Contractor who offers equivalent solutions must unquestionably demonstrate in the offer that they meet the requirements specified by the Contracting Authority (equivalence criteria indicated in the Description of the subject of the contract - Annex 5 to the SWZ).

The Contractor offering an equivalent product is obliged to provide in the Price Form – Annex 3 to the SWZ (in the column "Offered manufacturer NSN / PN") the exact name and description of the equivalent product (including the name of the manufacturer - if applicable, NSN - if there is also P/N), on the basis of which the Ordering Party will be able to unquestionably identify the offered assortment and get acquainted with its technical parameters.

The deadline for the contract is 180 calendar days from the date of signing the contract, but no later than by 20.11.2023.
