The subject of the order is the supply of fuels including the delivery of diesel fuel to Ordering tanks located in the five Plant in the localities: Radziądz, Ruda Sułowska, Stawno, Potasznia, Krośnice according to the following assumptions:

estimated total volume of diesel fuel is 400 000 liters (in words: four hundred thousand liters

1. The subject of the order is the supply of fuels including the delivery of diesel fuel to the Ordering tanks located in the five Plant in the localities: Radziądz, Ruda Sułowska, Stawno, Potasznia, Krośnice according to the following assumptions:

1) the estimated total amount of diesel fuel is 400,000 liters (in words: four hundred thousand liters),

2) The Contractor must ensure the delivery of diesel fuel within a period of not more than 72 hours after the contract has been made during the term of the contract,

3) deliveries will be carried out by Contractor's autocysterns equipped with hoses providing encapsulation at the sink of diesel fuel into the Contracting Authority's tanks,

4) The Contractor shall be obliged for each delivery to attach a certificate of quality (laboratory judgment) of the diesel supplied. The judgment must contain the basic data characterizing the fuel and must be provided on the date of the test.

5) Single deliveries minimum 10-ten thousand litres broken down into five subordinate establishments indicated in Chapter IV, point 2 of the SIWZ. Frequency of deliveries once or twice a month depending on the needs of the Ordering Party.

6) The Contracting Authority requires that the Contractor shall pay a guarantee deposit in the amount referred to in Article 105b (2) of the Act of 11 March 2004 on Goods and Services Tax (Journal of Laws of 2021, item 685, as a security for payment of payment tax in connection with the making of supplies. The fact of deposit should be confirmed by the entry in the Ministry of Finance list available at www.mf.gov.pl. The Contracting Authority shall require the provision of proof of the abovementioned deposit with the offer. The Contracting Authority shall request a certificate from the Tax Office and a print from the electronic list kept by the Minister responsible for public finances confirming that the contractor as the supplier of goods has submitted a guarantee deposit of PLN 1 million - as a document confirming the fulfilment of the condition in question.

2. Purchased fuels referred to in point 1 shall comply with the requirements set out in:

1) Regulation of the Minister of Economy of 9 October 2015 on quality requirements for liquid fuels (Journal of Laws 2015, item 1680),

2) standard PN-EN 590:2017 +A1-06 (U). Diesel oils. Test requirements and methods,

3. In accordance with applicable law, in the event of a discrepancy between the standard and the regulation, the Regulation has a superior value.

3. Detailed provisions concerning the conditions for the performance of the subject of the contract are contained in the model of the public procurement agreement constituting Annex No 3 to the SWZ.
